The Fidesz had been curing – It could have been prevent the lot of penalty

Really it should have been only this, and then the Hungarian tax-payers shouldn’t have to pay the penalty damages because of the case transferences? It’s a public joke.



We can start this story from far away, but there is no sense for the enumeration. They will do this a few years later on the law schools, when probably the purpose which allusive the special criminal cases and which is supported by the 2/3 government will be a curriculum in there.


This made it happen that Tünde Handó, who was newly elected president of the National Judicial Office in the January of 2012, could appoint court which are equal in scope but it’s diverge than the general cognizance courts in politically tender cases, like the Sukoró’s plot change, the BKV case, or the trial of György Hunvald. The National Judiciary Office had the same charge from lot of sides, that they appoint these kinds of cases according a sin which countryside court has a stricter or more extenuate judgment, according to the earlier cases.

Let’s go to Kecskemét

The BKV case should had been trial in the Budapest Court, but Tünde Handó appointed it to the Kecskemét Court in the February of 2012, with the allude to the workloads of the other court. Against the decision the concerned people couldn’t make an appeal but they made a constitutional complaint and they asked for suspend of the process. All of this didn’t block the process, the appointed judge started the case in the Kecskemét Court. She questioned all the defendants and almost all of the witnesses. Roughly after 50 days of hearings December of 2013 came, when the Constitutional Court in their decision established that the laws about the case transferences were repealed by the Parliament and it’s come up against the Basic Law and against the international rules. 





Until the Constitutional Court needed almost 8 months for the creation of their stand, the appointed courts in the countryside couldn’t wait. Apropos of the BKV case, Kecskemét also, almost right away, established their missing of the competent and it’s sent it back to the Court of Budapest. However from their answer came immediately that they don’t have their competent either. The Mansion joined the „Who doesn’t want to do the trial of the Hagyó case” game, but it seems like that they already slipped out from the 3 months what the criminal process law gave as a deadline. In principle it would mean that they can’t continue those, the legal process is to start the trials again from the beginning. Among of new locations, new judges and new circumstances. And apparently this is not going to be this easy in complex criminal processes like this. And although we cannot know a lot, it seems sure that for example the case of Miklós Hagyó will hardly have a judgment in first instance before 2016.


New solution


Not even then, if Tünde Handó’s new reply is pay off for the decision from the Constitutional Court. On the last week it turned out that the Court of Appeal of Budapest ordered the Court of Appeal of Debrecen’s president and 23 judges, based on the law of the judges’ claim status and allowance from the 1st of March until June 30, 2015. The detached-service of the judges doesn’t qualify as unique case transference, the process legally seems invulnerable. Because on paper the judge from the Court of Appeal Of Budapest’s judge is adjudicate above everyone, it is true that not is Budapest but in Debrecen. In the connection of this, after 2 years of complication, only one question come up: if this solution prove to be viable and the caseload, which is constantly parrot from the National Judicial Office and which is wished, is going to ease down for the judges from Budapest. For them with this legal technical step it’s going to be realistic, then what was the use of the case transferences based on unique decisions?


Why did the Fidesz had been curing on this? What was the use of causing international storms? A lot of people in a lot of way indicated for the lawmakers who have 2/3 in the parliament, that the principle of the trustworthy process is injured if the president of the National Judicial Office can transfer criminal cases to another court. With the designation, the right for a legal judge and equitable court is injures. And this cannot be done in Europe.


This is one of the aspects of this story. The other one is relatively easier. However we are not going to know exact numbers, but we can be sure that the terrifying expense of these case transferences are paid by the tax-payers. So as the penalties which is obligated the Hungarian government by the European Court of Human Rights in Strasbourg.

Tényleg csak ennyi kellett volna, hogy ne kelljen a magyar adófizetőknek büntetéseket és kártérítéseket fizetni a peráthelyezések miatt? Közröhej.

Kezdhetnénk messziről ezt a történetet, de nincs értelme a hosszas felsorolásnak. Megteszik ezt majd ez a jogi egyetemeken néhány év múlva, amikor vélhetően tananyag lesz a kiemelt büntetőügyek mihamarabbi lezárását célzó, kétharmaddal megtámogatott kormányzati szándék.

Ez tette lehetővé a 2012 januárjában hivatalba lépett Handó Tündének, az Országos Bírósági Hivatal újonnan megválasztott elnökének, hogy olyan politikailag kényes ügyek tárgyalására, mint a sukorói telekcsere ügye, a BKV-per, vagy Hunvald György pere az általános illetékességű bíróságtól eltérő, de azonos hatáskörű bíróságot jelölhessen ki. Az OBH-t ennek kapcsán több oldalról is az a vád érte, hogy ezeket az ügyeket aszerint osztja szét a vidéki bíróságok között, hogy a korábbi gyakorlat alapján hol várható szigorúbb vagy éppen enyhébb ítélet.


Irány Kecskemét

A BKV-pert illetékességből a Fővárosi Törvényszéken kellett volna tárgyalni, de Handó Tünde a bíróság leterheltségére hivatkozva 2012 februárjában a Kecskeméti Törvényszéket jelölte ki. A döntés ellen az érintettek nem fellebbezhettek, ám alkotmányjogi panaszt tettek, s kérték az eljárás felfüggesztését. Mindez nem akasztotta meg az eljárást, a kijelölt bíró Kecskeméten elkezdte az ügy tárgyalását. Meghallgatta az összes vádlottat, és szinte valamennyi tanút. Nagyjából ötven tárgyalási napot követően jött el 2013 decembere, amikor az Alkotmánybíróság határozatában megállapította, hogy az időközben az Országgyűlés által hatályon kívül helyezett, az ügyek áthelyezését lehetővé tevő törvényi szabályok az Alaptörvénybe és nemzetközi szerződésekbe ütköznek.

Amíg az Alkotmánybíróságnak majd nyolc hónapjába telt állásfoglalásának megalkotása, a kijelölt vidéki bíróságok nem várhattak. A BKV-per kapcsán Kecskemét szinte rögtön megállapította illetékességének hiányát, és visszaküldte az ügyet a Fővárosi Törvényszékre. Csakhogy onnan is szinte kapásból jött a válasz, miszerint nekik sincs illetékességük. A "Ki nem akarja a Hagyó-pert tárgyalni?" című játékba bevonták a Kúriát is, de úgy néz ki, hogy időközben kicsúszott az ügy abból a három hónapból, amelyet a büntetőeljárási törvény határidőként megszabott. Elvben ez azt jelentené, hogy folytatni azokat már nem lehet, a perek tárgyalásának újrakezdése a törvényes eljárás. Új helyszínek, új bírók és új körülmények között. És nyilvánvalóan ez nem lesz egyszerű ilyen összetett büntetőügyekben. S bár sokat még most sem tudni, annyi már bizonyosnak látszik, hogy például Hagyó Miklós ügyében első fokú ítélet 2016 előtt nehezen jöhet össze.

Új megoldás

Még akkor sem, ha beválik Handó Tünde új válasza az Ab döntésére. A múlt héten derült ki, hogy a bírák jogállásáról és javadalmazásáról szóló törvény alapján március elsejétől 2015. június 30-ig a Fővárosi Ítélőtáblára rendelte a Debreceni Ítélőtábla elnökét és 23 bíráját. A bírák kirendelése nem minősül egyedi ügyáthelyezésnek, az eljárás jogilag támadhatatlannak tűnik. Papíron ugyanis mindenki felett a Fővárosi Ítélőtábla bírája ítélkezik, igaz, nem Budapesten, hanem Debrecenben. Ezzel kapcsolatban így két év jogi hercehurca után csak egy kérdés vetődik fel: ha ez a megoldás életképesnek bizonyul, és a hőn áhított - az OBH részéről folyamatosan szajkózott - ügyteher-csökkenés a fővárosi bírák számára ezzel a jogtechnikai lépéssel reálissá válik, akkor mi értelme volt az egyedi döntésen alapuló peráthelyezéseknek?

Miért izmozott ennyit rajta a Fidesz? Mi értelme volt nemzetközi viharokat okozni? Hiszen sokan, sokféleképpen jelezték a törvényhozó kétharmad felé, hogy sérül a tisztességes eljárás elve, ha büntetőpereket másik bíróságra helyezhet át az Országos Bírósági Hivatal vezetője. A kijelöléssel ugyanis sérül az érintettek törvényes bíróhoz és pártatlan bírósághoz való joga. Ezt pedig Európában nem lehet megcsinálni.

Ez az egyik aspektusa ennek a történetnek. A másik viszonylag egyszerűbb. Bár pontos számokat nem fogunk megtudni, de annyiban biztosak lehetünk, hogy a peráthelyezések kapcsán felmerülő horrorisztikus költségeket a magyar adófizetők állják. Ahogy a büntetéseket is, amelyek megfizetésére a strasbourgi Emberi Jogok Európai Bírósága kötelezi a magyar államot.
