The Hagyó-case: according to the Prosecutor General it was not legally established to interrogate Demszky - atv.hu

It was not legally established to interrogate Gábor Demszky, former Lord Mayor, in relation to the so called BKV-lawsuit against Miklós Hagyó, former socialist Deputy Lord Mayor, and his co-defendants - said Imre Keresztes, the Chief Prosecutor of the High Prosecutor’s Office of Central Investigations at the press conference taking place on Monday.


The journalists present pointed out that it is a case in which the authorities investigated the responsibility of the Deputy Lord Mayor and Demszky’s former inferiors and the abuses taking place in a company of the capital. 

MSZP: The Fidesz feeds the media with show trials - nepszava.hu

According to the MSZP the Fidesz is trying to increase their support by initiating show proceedings and they can find people at the Prosecutor’s Office who are happily willing to provide assistance to the Fidesz with their methods associated with the “darkest dictatorships”.


Gergely Bárándy, vice-president of the socialist legislative board of the Parliament stated: during the criminal procedure brought against Miklós Hagyó, former socialist Deputy Lord Mayor, and his co-defendants, it turned out that the charges were groundless lies. There was no Nokia-box, there were neither bribes nor corruption. Those who have provided assistance with the show trial were rewarded: for example the prosecutor bringing charges against Miklós Hagyó became István Tarlós’s, Lord Mayor’s chief advisor.

Why is the work of prosecution questionable?

The BKV-case is a good example of how successfully can the prosecution, the police and the court work together when the political interest requires so. One of the most important roles was performed by prosecutor Szabadváriné Dr., the chief of the Department of Special Investigation. It can be hardly considered to be correct that the first highly illegal arrests and interrogations in relation with the investigation took place with her approval – just as the fact that later she was awarded for this by Tarlós. Not to mention that the charges related to the Nokia-boxes were dealt with unexceptional attention and priority – often ignoring the related processes. The investigation in the case of the well indicated bribery was launched after Balogh unsaid his testimony. Until that time it was considered as a charge supported by one single person’s statements.


Who did initiate the prosecution in the BKV-case?

The scandal around the severance pays paid by BKV broke in 2009, not much before the parliamentary elections. The Fidesz, of course, abused the situation and they were continuously attacking the coalition leading the capital. The first charges were made by the future lord mayor as the representative of the party. István Tarlós turned to the prosecutor’s office in connection with the above mentioned severance pays on July 29, 2015.

Here is the list: policemen, prosecutors and judges proving their loyalty to Orban earn millions


A couple of days ago it was revealed that Zsolt Nagy, ex-investigator responsible for the Hagyó-case, earns a million per month at the BKV. However, he is not the only one who has been assigned a position of a competitive salary in return for their services and loyalty. Although, since then it has become obvious that - putting it slightly - they committed a bunch of “professional mistakes”.


The prosecution has failed to prove the charges against Hagyó and his co-defendants. Before the court the defendants and the witnesses talked about their earlier statements as given under coercion. Zsolt Balogh withdrew his story about the Nokia-boxes two and a half year ago. What is more, in March 2015 he publicly apologised to the ones who he had incriminated with his false statements. Finally, the prosecution also admitted that his story about the corrupt money cannot be proved with evidence. This, however, has not meant a hindrance to reward all the policemen, lawyers, prosecutors and judges acting according to the political interest.

The ex-investigator having been responsible for the Hagyó-case currently earns a million forints a month at the BKV.


A new name can be put on the list of the winners of the BKV-case: it has turned out that the then investigator responsible for the Hagyó-case earns millions as the deputy project director of the DBR Projekt Metró Board.


It has been reported several times that policemen, lawyers, prosecutors and judges acting according to the political interest have been all rewarded for their readiness – despite the fact that it was proved in many of the cases that they had made “professional mistakes”.

Who are the main protagonists taking advantage of the case?

György Pető leading the investigation got the lead of both FKF and FBI. Ottó Halász conducting Hagyó’s interrogation became the deputy director of the security board of FKF. Gábor Tóth currently is the supervisor of a public security working group at the Municipality of Budapest, where he can work together with more of his ex colleagues and other police higher-ups. Iván Szabó was awarded with the Order of Merit of the Republic of Hungary, Officer’s Cross, while Imre Keresztes was awarded with the Order of Merit of the Republic of Hungary, Commander’s Cross. Prosecutor, György Győri became the chief-deputy prosecutor of the Prosecutor’s Office in district XI and XII. Mária Szívós thrives as constitutional court judge.



So the ones who performed major roles in blackening the BKV-case were rewarded?

Exactly. Police officers, lawyers, prosecutors and judges acting according to the related political interests were awarded, despite the fact that they had committed – gently saying -“professional mistakes”.

The Prosecutor’s Office also has disbelief in the story of the Nokia-box.

At the trial of the BKV-case on Tuesday, the prosecution also arrived at the conclusion that the main count against Miklós Hagyó – the receipt of the bribes hidden in the Nokia-box - could not be substantiated any more after the only incriminatory testimony had been unsaid before the court. Interestingly, the prosecution initiated the related investigation only after bringing charges against the former Deputy Lord Mayor of MSZP.

The most serious count of the indictment against Miklós Hagyó, former Deputy Lord Mayor of MSZP, seems to be refuted in the lawsuit heard at the Court of Kecskemét.

The count against Hagyó was based on Zsolt Balogh’s, former Chief Executive Officer of the BKV’s, contradictory statements made earlier during the investigatory phase. 





The statements made on the bribes delivered in the Nokia-box and becoming well-known in 2010 were unsaid by Balogh during an earlier phase of the lawsuit in 2012. This year he asked Hagyó for his apologize at the trial, furthermore he claimed: he had never delivered money to Hagyó, either in a Nokia-box or any other way. On Tuesday at the trial the prosecution admitted that the statements on the Nokia-box could not be proved.

How did the parliamentary elections affect Hagyó’s nokia-box case?


A couple of minutes after the National Assembly had been established, Hagyó was arrested at his home. He was handcuffed despite the fact that he had declared his intention to cooperate to the police in advance in writing, furthermore there was no intent to escape shown. Hagyó was remanded in custody which was prolonged three times without – all together for 9 months - considerable justification by Mária Szívós and the prosecution led by Imre Keresztes. Hagyó turned to the European Court of Human Rights in Strasbourg for remedy. Meanwhile he was also accused of being in an unlawful relationship with his partner. They decided in his favor in both the cases.



What were the reasons for Hagyó’s custody?


The related orders usually referred to the intent to escape and hide as the reasons for Hagyó’s keeping in custody. His custody was prolonged by Mária Szívós basically simply repeating the same reasons. Hagyó finally spent all together 9 months in custody based on rather doubtful reasons.

There are people who had profit from this...
While Hagyó Miklós and the other defendants of the BKV case were in pre-trial detention, until then other people -  including a defendant and the people from the jurisdiction – got really good positions/had been in really good positions. Without getting the full picture, let’s see one after the other, who and how got favorable positions indirectly and directly by Fidesz, or just how they attached/connected to the party, which had basic stake to support the quote  „corrupt socialists” what they used as a saying in their communications.
As it turned out from the compilation of Népszava:
-       Pető György, formal Deputy Lord Mayor of Óbuda – who was known as the political rival of Hagyó – was hired to the BRFK (Main Police Office of Budapest) in March, 2010, to the department where they investigate the BKV case. After the Fidesz won the local government he got a job from the Lord Mayor, Tarlós István. First he was the leader of the Supervision of the Public Places in Budapest, then he was the leader of the Bureau of Security in Budapest, which so called „FBI of Budapest”.
                          









   

-       Schmidt Gábor, published a book called „Corrupt Companies of the Left Party” in September, 2010, where – as you can realize from the title – he made the BKV case to be the tool of the right party’s campaign.  After the fidesz won the local government he got a job at the city hall from the new Lord Mayor.
-       Keresztes Imre, the leader of the Central Bureau of Investigation got the Order of Merit of the Republic of Hungary (Commander’s Cross) on the 15th of March, 2011. They said „For keep counting on the public interests, and his achievement of investigations in extremely complicated and legal cases”.

-       Győri György, crown counsel/prosecutor, who worked on the case, became the Deputy Public Prosecutor of the 11th and the 22nd district.
-       Balogh Zsolt became the CEO of the Public Transport Company in Pécs, which was leaded by Fidesz and had been enclosure in suspicious condition - turned out on the 10th of February, 2012. After he was elected the PK Busrent KFT desisted the legal actions with the local government, and the city „got back” their buses.

-       Szívós Mária, judge, who extended Hagyó’s pre-trial detention. The majority of the governing party in the parliament elected her to be the member of the Constitutional Court on the 27th of June, 2011.

Míg Hagyó Miklós és a BKV-ügy több gyanúsítottja előzetes letartóztatásban ült, addig más szereplők - köztük egy vádlott és az igazságszolgáltatás emberei is - kedvező helyzetbe kerültek. A teljesség igénye nélkül vegyük sorra, hogy kiknek és hogyan kedvezett közvetve vagy közvetlenül a Fidesz, vagy éppen csak hogyan kötődnek ezek a szereplők ahhoz a párthoz, amelynek elemi érdeke volt a kommunikációjában szófordulatként használt „korrupt szocialisták” jelzős szerkezet alátámasztása.

 Pető Györgyöt, Óbuda korábbi szocialista alpolgármesterét - aki köztudottan Hagyó politikai riválisa volt - 2010 márciusában felvették a BRFK állományába, a BKV-ügyben is nyomozó osztályra, majd a Fidesz önkormányzati győzelme után állást kapott Tarlós István főpolgármestertől. Előbb a Fővárosi Közterület-felügyelet, majd a budapesti FBI-ként emlegetett Fővárosi Biztonsági Iroda vezetője lett.

- Schmidt Gábor 2010 szeptemberében"Baloldali Korrupciós Vállalat" címmel könyvet jelentetett meg, amelyben - mint az már a címből is kiderül - a BKV-ügyet a jobboldal kampányának eszközévé tette. Schmidt a Fidesz önkormányzati győzelme után állást kapott a városházán az új főpolgármestertől.

 Keresztes Imre, a Központi Nyomozó Főügyészség vezetője 2011. március 15-én a Magyar Köztársasági Érdemrend Középkeresztjét kapta "a közérdeklődésre számot tartó, kiemelkedően bonyolult tényállású és jogi megítélésű ügyekben folytatott nyomozások során nyújtott teljesítménye, továbbá eredményes ügyészi és vezetői pályafutása elismeréseként".

- Győri György ügyész, aki dolgozott az ügyön, 2011. május 31-én a XI. és a XXII. kerületi ügyészség vezető-helyettes ügyésze lett.

 Balogh Zsolt a fideszes vezetésű Pécs buszközlekedését korábban gyanús körülmények között "privatizáló" közlekedési cégnél vezérigazgatói állást kapott - derült ki 2012. február 10-én. Kinevezése után a PK Busrent Kft. elállt az önkormányzattal folytatott jogi vitától, a város pedig "visszakapta" buszait.
