Did the BRFK proceed correctly in the BKV case?

During the trial of the BKV case the accused claimed one by one that their testimonies  - incriminating both themselves and the other accused, primarily Hagyó – were given under coercion. Some of the accused called the procedure a show-trial, others simply described the incident as a political showdown.




Does it mean that before the court the accused and the witnesses gave different testimonies from the ones they had given to the investigators?


Yes, it does. What is more, the testimonies heard at the trial in Kecskemét are in a sharp conflict with the ones given in the investigation period. The vast majority of the main defendants and witnesses unsaid their testimonies given in the investigation period and they gave a new testimony before the court. The testimonies incriminating others were stated to have been given as a result of police threat, in exchange for their release, under humiliating circumstances, furthermore they had been given under direction and coercion.

When did BRFK start the investigation?

Although there were no condemning investigations at BKV before 2008, BRFK entered the campaign in 2010. One day after Hagyó resigned from BKV’s supervisory board Gábor Tóth police chief informed the transporting company about continuing criminal procedure. Police initiated the arrest of Szalainé 90 days prior to the elections and kept on accusing BKV persons. The investigation landed in the hands of Hagyó’s former political rival: György Pető used his position to recruit managers of some companies owned by the capital before the municipality elections, who were supposed to be informants to the police.



There were really no condemning internal investigations at BKV?

Really there were not. Two internal investigations stated in 2008 that all the contracts of the affected period are ok. Supervisory Board accepted the investigation of the Internal Supervisory Department on October 16, 2008 with respect to that those reports contained the entire advisory circle and there were no ascertainments that would have requested further steps to take. The general meeting of 2008 accepted Zsolt Tiba’s report (capital clerk) with the attachments which were reports on the contracts between BKV and AAM Zrt.

Contradictions in the confessions of the accused of IV order

Before proceeding to the contradictions among the confessions of Zsolt Balogh I would like to draw the reader’s attention to an interesting event of the investigation. Before the arrest of Miklós Hagyó he indicated to the investigating authority on 11th May 2010 that he shall be at their disposal, he lives in his residency and gave all of his availabilities. In spite of this the police failed to interrogate Hagyó before his arrest of 14th May 2010.


Zsolt Balogh also offered his testimony to the investigating authority in the first half of October 2009 howver he was interrogation only in February 2010 firstly as witness and then as a suspect as stated in the letter dated on 8th April 2011 and addressed to the K.D. Marshall.

Gábor Tóth was born in Kalocsa, October 28, 1966. He graduated in Bólyai János Military Technical College then he completed the criminal academic expertise in the Police Officer College and ELTE Faculty of law. He started his career as a military prosecutor investigator in 1988; he served in five different districts in Budapest as a detective, deputy chief of investigation division, deputy chief of criminal division and as the chief of the police station between 1990 and 2003. He had been working as the criminal deputy chief of the Chief of Metropolitan Police of Budapest between 2003 and 2007. (The Metro Police Chief couple are expecting a baby – Vevet, 02.02.2008)

A news came to light in the Hungarian media in March 2010 which shocked the whole country. This served the proof to the ones who criticize the Gyurcsány-government that the socialist-liberal administration is rotten to the core. The indictment was characterized in the article of HVG journal as “carelessly supported political pamphlet” since you cannot find a single document from the tens of thousands of pages which could support the accusation of crimes committed in criminal organization. There is not a slightest evidence or circumstance beside the preamble of the indictment that would lead to the allegation of some Mob-crime. the journalist writes an example that due to the standpoint of the indictment “Ernő Mesterházy mediates  the interests of the companies connected to the Lord Mayor toward BKV”. The method of how he did, who are the circles of Demszky (Lord Mayor at that time) and the prosecutor did not initiate the interrogation of Demszky Gábor as witness. There are only three crimes with which the prosecutor accuses Hagyó out of the fifty ones listed in the indictment. The evidences are mostly attestations by witnesses which are rarely incriminating. For instance János Pálocska – a company owner connected to BKV – based his attestation on rumors, second-hand information.

Coercions, magisterial impositions in the Hagyó-case - SUMMARY



Gábor Tóth police superintendent during the whole investigation of the BKV case stated confidently about the process. He undertook it with name that they have the investigation in their hand and he was talking about new evidences and about conclusions what they got from the investigation testimonies.




Contrarily the testimonies which were heard in the case’s trial in Kecskemét from the defendants and from the witnesses sharply confronted with the testimonies of the concerned in the investigation period. From the main defendants and from the witnesses most of them unsaid their investigation testimonies and in the court they did a new testimony. They said about their earlier, incriminatory testimonies against others that they only did it because of police threat, in the exchange of their lives, in humiliation circumstances, it was directional and under coercion.

Ernő Mesterházy, the former advisor of Gábor Demszky on the court he offended the investigators, he called his brought to justice a recklessly violator process. He indicated that he is standing uncomprehendingly in front of the process against him which, according to him „conception, recklessly violator and it’s obligate to serve a political, human, and financial disable”. Moreover he said that according to the record the questioning was for almost 11 hours but the result was only two pages long, the investigation authorities humiliated him and tried to convince him to say an incriminatory testimony against Miklós Hagyó and if he does it than they will let him go from detention.

In the Hagyó case the renounced testimonies prevailed. It turned out that the legend Nokia box didn’t happen, and a lot of defendants complained that during the interrogation period their testimonies were forced out.
The trial of the year was without doubt the BKV case which was in Kecskemét. The hearing series which is in the case of Hagyó Miklós and his fellows raised dust that the wife of Szájer József (FIDESZ party, representative of the EP) transferred the case to a city in the county of Bács-Kiskun.
Until the end of the year almost all the defendants were heard. The there said things was way different than they recorded in the period of the interrogation. A number of people – Antal Attila and Balogh Zsolt (former CEOs), Mesterházy Ernő (former advisor of Demszky Gábor), L. Ottó and R. Miklós – renounced their before testimonies and they made a new one in front of the court which lead by Hadnagy Ibolya judge. From the main defendants a lot of them said that they did their testimony under threat, in humiliating circumstances and it was directed, and they complained for situations which were almost like coercion. Most of them said that the investigators asked testimonies against Hagyó Miklós and people around him in the exchange of their freedom, and one of them stated in the court that they even tried to induce him to say incriminatory things against Gyurcsány Ferenc who is a former prime minister.

The biggest surprise came from Balogh Zsolt. The former CEO who renounced his testimony said that the story about the slush-fund which was handed in Nokia box wasn’t true. As he said: in the time of the election he was saying this to the media to suit for the expectations, so then he can avoid jail.
Of course the trial is not over, they only made winter holiday, and they continue the trial in January.

A Hagyó-ügyben a visszavont vallomások domináltak. Kiderült, hogy nem létezett a legendás Nokia-doboz, és több vádlott panaszolta, hogy a nyomozati szakaszban kikényszerítették a vallomását.

Az év bírósági ügye kétségkívül a Kecskeméten zajló BKV-per volt. A Hagyó Miklós és társai ügyében folytatott tárgyalássorozat már azzal nagy port kavart, hogy Szájer József fideszes EP-képviselő felesége az Országos Bírósági Hivatal elnökeként a Bács-Kiskun megyei városba helyeztette a pert.
Év végéig sor került a vádlottak nagy részének vallomástételére. Az elhangzottak messze eltértek a nyomozati szakaszban rögzítettektől. Többen - Antal Attila és Balogh Zsolt korábbi vezérigazgatók, Mesterházy Ernő, Demszky Gábor tanácsadója, L. Ottó és R. Miklós - visszavonták korábbi vallomásukat, és újat tettek a Hadnagy Ibolya elnökölte bíróság előtt. A főbb vádlottak közül többen elmondták, hogy a nyomozati szakaszban tett vallomásukat fenyegetés hatására, megalázó körülmények között, irányítottan tették, kényszervallatás-szerű helyzetekre panaszkodtak. Többségük arról nyilatkozott, hogy a nyomozók Hagyó Miklósra és környezetére kértek terhelő vallomásokat a szabadságukért cserébe, de egyikük a bíróság előtt azt állította, hogy megpróbálták rábírni, hogy Gyurcsány Ferenc volt miniszterelnök ellen tegyen vallomást.

Az eddigi legnagyobb meglepetést Balogh Zsolt keltette. A vallomását visszavonó volt vezérigazgató ugyanis kijelentette, hogy a Nokia-dobozokban átadott kenőpénzekről szóló sztori nem igaz. Mint mondta: a választási kampány idején azért nyilatkozott így a médiának, hogy megfeleljen az elvárásoknak, mert azt gondolta, így elkerülheti a börtönt.

Természetesen a per még nem ért véget, csupán téli szünetet tartanak, januárban folytatják a tárgyalást.

The BKV case abounds in interesting turns. As a matter of fact we should cry on the trial which more and more reminds us to a concept trial in the 50’s, which is against Hagyó Miklós, former deputy lord mayor and his 14 associates in the Kecskemét Tribunal. Yes, in Kecskemét, because the trial was transferred to the countryside’s small town, because of the order from Handó Tünde who is the wife of Szájer József (EP representative) and she is the one who control the prosecutions. It didn’t happen before: Budapest’s obsession doesn’t happening in the capital.

However it’s a fact that they shoot to everyone who they can hit. Don’t be so surprised: Budapest is an enemy, a city which is liberal-minded in the so called heart of a Christian-conservative country.
But no avail Kecskemét, no avail the hope of the government that the case will be in good hands – in the case of Zuschlag János they made here a dismiss adjudication – the testimonies fall down one after another because the defendants renounced them all. For example Mesterházy Ernő made a complaint because they persuaded him for 11 hours to make an incriminatory confession against Hagyó Miklós. He didn’t, but the investigators still collated with the prosecution during the questioning, and the record is only 2 pages long. Hopefully the others didn’t land at the media. Or maybe it would be better? But it is all the same, it would have only gone to the papers of the government…

While the witch hunt was still running in the BKV case, the authorities had to proceed in other cases too. Not that they were successful: Hunvald György and Molnár Gyula was absolved from the accusations, so then they used the same strategy on Juhász Ferenc, former Minister of National Defense, what they did with Hagyó Miklós. As it known they stated that in similarity to the Nokia-boxes he got the money in box too, but it was whiskey box where he got all the illegal money. Yeah, sure, but the whiskey had been already used in another case: the robber who was called as „whiskey robber”, Ambrus Attila, but he didn’t do any politics.

There was not a long waiting for the new turn. Antal Attila the former CEO of the BKV similarity to Mesterházy Ernő, he was talking about coercion too and he renounced his previous testimony. The moment approached when they have no evidence against the defendants of the BKV case.

Of course now they can tumble, they gain one’s end/got what they want: they succeeded to mire the politicians – remember, just before the elections! – that the constituent had no other chance to vote against them, against their party. Everybody knew that these trials counted a lot on the now 2/3 majority in the parliament. Okay, they had to mire a former prime minister, but they could do that easily.

The biggest twist is still not here. The defendant who originally made paradox testimonies, Balogh Zsolt said, that he only made up the Nokia-box story so then it will suit for the expectations what the authority asked for. Not just that there was no money in the place of the phones but there were no boxes either.

Of course when the case turned into a place where Hagyó Miklós could also get a word, he was ordered, but he also brought presents with himself: objects what the BKV’S present leaders ordered from public money for marketing. With this he wanted to show that it’s inexplicable that why they call past actions crime when now it’s not. He lay down beach balls and balloons on the table, because he couldn’t get flowers.

We don’t know what will be the end. We don’t know if the court will say against Hagyó Miklós and his associates that they are guilty. However, how this things looks like, this method of the justice, if it’s not seems like it’s from the stone age then it’s from the 50’s. And if it wouldn’t go to our skins through the defendants we could say it’s funny as the Flintstone family. But it’s more and more tragic. Our drawer put nothing in the bubble of Hagyó Miklós-Frédi, correctly. Because this game is still on.

Érdekes fordulatokban bővelkedik a BKV-per. Valójában sírnunk kéne az egyre inkább az ötvenes évek koncepciós-pereire emlékeztető tárgyaláson, amelyet Hagyó Miklós egykori főpolgármester-helyettes és 14 társa ellen folytat a Kecskeméti Törvényszék. Igen, a kecskeméti, hiszen a pert Szájer József EP-képviselő felesége, az ügyészségeket felügyelő Handó Tünde utasítására a vidéki városban folytatják. Ilyen sem volt még: Budapest ostroma nem a fővárosban zajlik.

Viszont tény, hogy lőnek mindenkire, akit csak véletlenül el lehet találni. Ne csodálkozzunk: Budapest ellenség, egy liberális szellemű város az állítólag keresztény-konzervatív ország szívében.
De hiába Kecskemét, hiába a kormányzati remény, hogy jó kezekbe került az ügy – Zuschlag János perében itt született elmarasztaló ítélet – a vallomások egymás után dőltek be, mert a vádlottak visszavonták őket. Mesterházy Ernő például azért tett panaszt, mert 11 órán át győzködték arról, hogy szabadsága érdekében tegyen terhelő vallomást Hagyó Miklósra. Nem tett, de a nyomozók így is folyamatosan egyeztettek az ügyészséggel kihallgatása közben, a jegyzőkönyv pedig mindössze két oldalasra sikeredett. Remélhetőleg a többi nem a sajtónál kötött ki. Vagy talán jobb lenne? Bár mindegy, úgyis csak a kormányzati lapokhoz jutott volna belőle…

Mialatt persze folyt a boszorkányüldözés a BKV ügyében, a hatóságoknak más esetekben is el kellett járniuk. Nem mintha sikerrel jártak volna: Hunvald Györgyöt, Molnár Gyulát felmentették a különféle vádak alól, így aztán Juhász Ferenc volt honvédelmi miniszterrel szemben azt a módszert használták, amit Hagyó Miklós ellen is bevetettek. Tudniilik, azt állították, hogy a Nokia-dobozokhoz hasonlóan ő is dobozban, csak whiskysben kapta a mindenféle illegális pénzeket. No igen, de a whisky már elsült egy másik ügyben: a viszkis rabló Ambrus Attila volt, de ő nem politizált.

Nem kellett sokat várni a fordulatra. Antal Attila volt BKV-vezérigazgató Mesterházy Ernőhöz hasonlóan kényszervallatásról beszélt, visszavonta korábbi vallomását. Közelített a pillanat, mikor a BKV-per vádlottjai ellen már nem maradt bizonyíték.

Persze most már bukhatnak, céljukat elérték: sikerült annyira besározni a megtámadott politikusokat – emlékezzünk, közvetlenül a választások előtt! – hogy a választópolgároknak nem maradt más választásuk, mint ellenük, és pártjuk ellen szavazni. Mindenki tudja, hogy ezek a perek milyen mértékben járultak hozzá a mostani kétharmados parlamenti többséghez. Jó, kellett még kicsit sározni egy volt miniszterelnököt is, de ezt már csípőből megoldották.

A legnagyobb csavar azonban még hátravolt. Az eleve ellentmondásos vallomásokat produkáló vádlott, Balogh Zsolt elárulta, hogy a Nokia-doboz históriáját csak azért találta ki, hogy megfeleljen a vele szemben támasztott hatósági elvárásoknak. Nemhogy pénz nem volt a telefonok helyén, de dobozok sem voltak.

Persze, amikor odáig jutott az ügy, hogy Hagyó Miklós is szóhoz jutott, azonnal rendre intették, pedig vitt magával ajándékot is: olyan tárgyakat, amelyeket a BKV jelenlegi vezetése a korábbihoz hasonlóan közpénzből rendelt meg marketing-célokra. Ezzel arra mutatott rá, hogy érthetetlen, miért nevezik bűncselekménynek a korábban történteket, ha most nem azok. Lufit és strandlabdát tett le az asztalra, mert virágot mégsem vihetett.

Még nem tudjuk, mi lesz a vége. Nem tudjuk, hogy a bíróság bűnösnek mondja-e ki Hagyó Miklóst és társait. Azonban, ahogy a dolgok kinéznek, az igazságszolgáltatás ezen módja, ha nem is kőkorszaki, de az ötvenes éveket idézi. És ha nem a mi bőrünkre menne a vádlottakén keresztül, azt is mondhatnánk, mulatságos az egész, mint a Flintstone család. De sokkal inkább siralmas. Rajzolónk azonban a Hagyó Miklós-Frédi szövegbuborékját üresen hagyta, helyesen. Mert ez a játszma még nincs lefutva.

Xpat Report: Authorities Allegedly Bribed BKV Suspect
Ernő Mesterházy, one of the main suspects in the high-profile BKV case and the former senior advisor to Gábor Demszky, said in his written statement during Thursday's hearing that the investigation authority had committed crimes during a previous hearing.


The hearing, which had occurred on February 26th, 2010, had lasted 11 hours and resulted in a meager 2-page summary, according to official records. Mesterházy implied in his written statement that the official summary did not include all of the events which transpired during the lengthy hearing.
He elaborated when he accused the investigation authorities of humiliating him and dishonoring his character by attempting to make him incriminate Miklós Hagyó, another main suspect who served as the Deputy Mayor of Budapest under the former Mayor Gábor Demszky. By doing so, Mesterházy would have been excused from his pre-trial detention sentence.
Mesterházy concluded his statement by suggesting that the accusations against him and Miklós Hagyó are politically motived when he said, “I don't know who is behind all of this, but it will unravel.”
After reading Mesterházy's written statement to the court, the judge reminded him of the dangers in making false accusations.

Xpat Opinion: Miklós Hagyó Responds To Attila Antal's 2010 Accusations
On Tuesday the trial of the eleven associates of the Budapest Public Transport Company (BKV) continued at the Kecskemét Court with the review of Mr. Attila Antal’s testimony from last week and a brief response from Mr. Miklós Hagyó.


Antal continued to withdraw his previous statements from a 2010 interrogation, when under alleged duress from the police, he verbally incriminated Miklós Hagyó, Ernő Mesterházy, and other defendants. The 2010 statements were, thereafter, used by the interrogation authority and the prosecution in charging Miklós Hagyó, among others, with misappropriation of public funds. It is speculated that the accused forced BKV upper-management to negotiate and approve a series of contracts under the guise of the public transport company with persons or organizations that were not considered appropriate for the contracted tasks, but instead were directly or indirectly profitable for Mr. Hagyó.
Though one might think that Mr. Antal had exausted his current testimony last week by renouncing his 2010 statements, in yesterday’s hearing he answered new questions neither from the defense attorneys nor from the prosection. Instead, at the urging of Judge Katalin Kutron who seeked to record the entire testimony into the court’s official records, he once again returned to the 2010 events. This time, however, he eleaborated on his motivations for his original accusations against Hagyó, Mesterházy, and the other defendants.

During the February 4th, 2010 interrogation Antal was recovering from a heart attack, which had required of him a resignation from his post as CEO of BKV. So, according to the former executive, when the police held him in custody during the 2010 interrogation he feared that he would not recover his full health under such circumstances. In that state, Mr. Antal provided for the police, what he said was, their desired accusatory evidence against the other defendants.
Apart from the requested repetition of his story, Mr. Antal did provide for the court new elements of the 2010 circumstances. He stated that he did, in fact, initially provide an “honest,” or otherwise unincriminating, testimony to the police. At that point the police, he claims, refused to grant him leave from the police station until three days later, when Antal verbally accused Hagyó, Mesterházy, and the other defendents.
Mr. Hagyó followed Antal in providing his opinions on the 2010 events. The former Deputy Mayor of Budapest said that he had met Attila Antal prior to the BKV scandal on a few occasions, when he perceived Antal to be of "honest" character. Though Hagyó did not understand why the former CEO accused him in 2010, thus, according to Hagyó, betraying those "honest" characteristics, Miklós professed his content at seeing the "real" Attila Antal in court.
Mr. Hagyó and his defense expressed their disapproval at not being provided the opportunity to confront Antal about his accusations prior to the current trial. According to Miklós's attorney, this would have permitted both parties to sort out the "contradictions."
