It was not legally established to interrogate Gábor Demszky, former Lord Mayor, in relation to the so called BKV-lawsuit against Miklós Hagyó, former socialist Deputy Lord Mayor, and his co-defendants - said Imre Keresztes, the Chief Prosecutor of the High Prosecutor’s Office of Central Investigations at the press conference taking place on Monday.


The journalists present pointed out that it is a case in which the authorities investigated the responsibility of the Deputy Lord Mayor and Demszky’s former inferiors and the abuses taking place in a company of the capital.

Why is the work of prosecution questionable?

The BKV-case is a good example of how successfully can the prosecution, the police and the court work together when the political interest requires so. One of the most important roles was performed by prosecutor Szabadváriné Dr., the chief of the Department of Special Investigation. It can be hardly considered to be correct that the first highly illegal arrests and interrogations in relation with the investigation took place with her approval – just as the fact that later she was awarded for this by Tarlós. Not to mention that the charges related to the Nokia-boxes were dealt with unexceptional attention and priority – often ignoring the related processes. The investigation in the case of the well indicated bribery was launched after Balogh unsaid his testimony. Until that time it was considered as a charge supported by one single person’s statements.


Who did initiate the prosecution in the BKV-case?

The scandal around the severance pays paid by BKV broke in 2009, not much before the parliamentary elections. The Fidesz, of course, abused the situation and they were continuously attacking the coalition leading the capital. The first charges were made by the future lord mayor as the representative of the party. István Tarlós turned to the prosecutor’s office in connection with the above mentioned severance pays on July 29, 2015.

Did also the indictment contain the Nokia-boxes?

At the beginning of 2012 the prosecution was brought. The Nokia-box count was based on exclusively and solely Zsolt Balogh’s contradictory statements. The indictment of course contains the case of the Nokia-boxes, however interestingly the Nokia-boxes themselves are not mentioned. In the indictment issued carelessly and inaccurately has a reference only to the 15-15 million forints which was delivered to Hagyó on a yearly basis. Any other details on the location, the time or other circumstances are not mentioned in it. The term „Nokia-box” does not occur in the text at all.


What does the indictment exactly say about the Nokia-box?

Literally the following:
Miklós Hagyó, first accused, as the Deputy Lord Mayor of Urban Management and Asset Management of the Budapest Municipality, abusing his official position in March 2008 instructed Zsolt József Balogh, fourth accused, as the Chief Executive Officer of the BKV to deliver 15 million forints to him on a yearly basis.

Did the Nokia-box case influence the municipality elections?

Of course, it did – Hagyó was suspected of the Nokia-boxes five week before the municipality elections. This was also the time when the records on the confrontation leaked out, which brought back the same public mood as before parliamentary elections. In fall – just like previously in spring before the parliamentary elections - the Nokia-box became a campaign topic again. Beginning a new wave of their attacks they used the BKV-severance pays as weapons. Later more socialist politicians were charged. The then mainly liberal and socialist Budapest failed. Although it has been revealed that the Nokia-box charges are false, the truth cannot change the results of the elections.

When and how did the record on Balogh and Hagyó’s confrontation leak out?

Again the timing of the right wing was careful and precise. The record on the police confrontation came to light during the campaign period of the elections. And although it is obvious it should be pointed out that the Magyar Nemzet did publish it under the following title “I live in fear of death by you, Miklós!”. Of course, the fact that the BKV-case was picked up again might have influenced the municipality elections as it might have done the parliamentary elections.

Péter Ottoné Szabadvári dr. - Her role in BKV-case

We do not know much of Szabadváriné’s carrier. You cannot find her CV on the internet or her exact date of birth and there is no information on her studies. The only thing which we know for sure is that she played a significant role in the BKV-case as the head of department of the Special and Economic Affairs of the Metropolitan’s Prosecutor’s Office.





She also took part in other metropolitan investigations in 2010. After this, she became one of the senior advisors of István Tarlós. However, she took this position under her husband’s family name, which seems to be logical if we take into consideration her doubtful cases.

The prosecutor getting Hagyó into custody is also one of Tarlós’s chief advisors


The former prosecutor who succeeded to have the former Deputy Lord Mayor of MSZP in custody appears on the list of Tarlós’s advisors by the name of her husband’s with a monthly salary of 850 thousand forints. Former counter intelligence agents and police officers involved in the BKV-case are employed by the capital city, as well.



One of the Lord Mayor’s most well-paid chief advisors is Péter Ottóné Szabadvári dr. The lawyer currently using his husband’s name at the City Hall worked as prosecutor by the name of Katalin Vámos: she was involved not only in the Hagyó-case but also in proceedings against more executives in Budapest. Her name also appears in cases of breach of state-secrets and in the cases in connection with the UD Ltd. She is not the only one who took a role in these cases and became employed by the capital after Tarlós had been elected.




The former prosecutor can be hardly recognized



On the salary list published by the Origo a couple of weeks ago the most well-paid advisor in the 14-member advisory team appears by the name of her husband, Péter Ottóné Szabadvári dr. The chief advisor working as special referee for a monthly salary of 850 thousand forints was identified by the Origo as the former prosecutor who had played an important role in the Hagyó-case.

The Prosecutor’s Office also has disbelief in the story of the Nokia-box.

At the trial of the BKV-case on Tuesday, the prosecution also arrived at the conclusion that the main count against Miklós Hagyó – the receipt of the bribes hidden in the Nokia-box - could not be substantiated any more after the only incriminatory testimony had been unsaid before the court. Interestingly, the prosecution initiated the related investigation only after bringing charges against the former Deputy Lord Mayor of MSZP.

The most serious count of the indictment against Miklós Hagyó, former Deputy Lord Mayor of MSZP, seems to be refuted in the lawsuit heard at the Court of Kecskemét.

The count against Hagyó was based on Zsolt Balogh’s, former Chief Executive Officer of the BKV’s, contradictory statements made earlier during the investigatory phase. 





The statements made on the bribes delivered in the Nokia-box and becoming well-known in 2010 were unsaid by Balogh during an earlier phase of the lawsuit in 2012. This year he asked Hagyó for his apologize at the trial, furthermore he claimed: he had never delivered money to Hagyó, either in a Nokia-box or any other way. On Tuesday at the trial the prosecution admitted that the statements on the Nokia-box could not be proved.

Gábor Tóth was born in Kalocsa, October 28, 1966. He graduated in Bólyai János Military Technical College then he completed the criminal academic expertise in the Police Officer College and ELTE Faculty of law. He started his career as a military prosecutor investigator in 1988; he served in five different districts in Budapest as a detective, deputy chief of investigation division, deputy chief of criminal division and as the chief of the police station between 1990 and 2003. He had been working as the criminal deputy chief of the Chief of Metropolitan Police of Budapest between 2003 and 2007. (The Metro Police Chief couple are expecting a baby – Vevet, 02.02.2008)

The legend of the Nokia-box and the pure truth - part 3

A news came to light in the Hungarian media in March 2010 which shocked the whole country. This served the proof to the ones who criticize the Gyurcsány-government that the socialist-liberal administration is rotten to the core. This prejudice has been created successfully by the right-wing media.



The indictment was characterized in the article of HVG journal as “carelessly supported political pamphlet” since you cannot find a single document from the tens of thousands of pages which could support the accusation of crimes committed in criminal organization. There is not a slightest evidence or circumstance beside the preamble of the indictment that would lead to the allegation of some Mob-crime. the journalist writes an example that due to the standpoint of the indictment “Ernő Mesterházy mediates  the interests of the companies connected to the Lord Mayor toward BKV”. The method of how he did, who are the circles of Demszky (Lord Mayor at that time) and the prosecutor did not initiate the interrogation of Demszky Gábor as witness. There are only three crimes with which the prosecutor accuses Hagyó out of the fifty ones listed in the indictment. The evidences are mostly attestations by witnesses which are rarely incriminating. For instance János Pálocska – a company owner connected to BKV – based his attestation on rumors, second-hand information.

In the hearings period of the BKV case, which is became called as the Hagyó case, the defendants and the witnesses in the case recalled their testimonies which was the biggest storm stirred

A lot of them referred to the fact that during the investigation against the Public Transportation Ltd. of Budapest and against a few former leaders of Budapest there happened several magisterial malfeasances. Ones reported about coercions, others revealed a lot of malpractices from the police during the investigation.

The police documents are bristles from the caveats. The defendants brought the attention to the court for falsely dated, lost documents and for documents which can have the forgery suspicion.

BKV case: other accusations fell

The prosecution got off 5 contracts from the counts. Again a document just turned up which wasn’t revealed for the defense. Since Tuesday it’s still big works in the BKV case.




It’s not the first time when a proof just turned out in the BKV case which was not shown to the defense. At this time it was about a letter where the CEO of the C.C. Soft wrote that outsider mistakes and connection problems with other companies set back the configuration works of the passenger informant system.

After the two weeks break the BKV case came back with bloopers to the Kecskemét Tribunal. The witness of the prosecution said on Tuesday that he made his incriminatory testimony based on gossips and his own theory. „They gossiped that Balogh Zsolt fear from Hagyó Miklós” – penned/said as a witness the present deputy CEO of the BKV, Takács Péter, alluded to the relationship between the former CEO of the transportation company and the former deputy lord mayor from MSZP.
With his hearing the prosecution tried to prove that Hagyó could bring pressure on the leaders of the BKV and that around their communicational contracts they had bawdy-house at the BKV. Anyway Takács tenderized all his earlier, incriminatory statements, he couldn’t name documentation proof, and according to his saying, he threw out to the suspicious contract to the garbage.

Before the hearing of the witness, Homonnai János prosecutor observed about the testimony of Csapó Gábor Olympic champion that „on his own experience” and according to the inspector of the allegiance of the rights, the BKV default with the expectations with the handicapped people. With this comment putatively he wanted to save the awkward moment where he was put into on the hearing of the water polo player who popularized the BKV. The prosecutor earlier – consonant with the indictment – said that the contracts with the Csapó Bt. was unneeded, when he financed the sport training of the sporting handicapped children from the incomings/proceeds of that contract.

Earlier the prosecutor asked from the Olympic champion who was heard as a witness, that upon what ground can he uses the swimming pools what gave home for his school. Csapó at that time told to the prosecutor with a general serenity that a lot of people know him.
For that matter the hearing of Takács Péter started hard, because the prosecution had to do change on the indictment what they continuously changed already. At this time the prosecutors rewrote the charges with the amount of a few contracts.

For the calling of a lawyer Homonnai had to answer for the question that where did the records of the questionings of Horváth Éva disappear where they pell-mell the dates. Now the prosecution alluded to „unintended clerical error” and „clamps and mixing of the documents” which similar to an earlier case connected to Hagyó with the forgery accusation. Horváth Éva wasn’t satisfied with the answer and similarly to the lawyer of Hagyó she indicated that the dates are still not good on the documents.

Bakiparádéval tért vissza két hetes szünet után a BKV-per a Kecskeméti Törvényszékre. A vád tanúja keddi meghallgatásán elmondta, hogy pletykákra és saját teóriájára alapozta terhelő vallomásait. "Azt pletykálták, hogy Balogh Zsolt tartott Hagyó Miklóstól" - fogalmazott tanúként a BKV jelenlegi vezérigazgató-helyettese Takács Péter, utalva a közlekedési cég volt vezetője és a korábbi MSZP-s főpolgármester-helyettes kapcsolatára.
Meghallgatásával az ügyészség azt próbálta bizonyítani, hogy Hagyó nyomást gyakorolhatott a BKV vezetőire, és hogy a kommunikációs szerződések körül "kupleráj" volt a BKV-nál. Takács amúgy lényegében minden korábbi, terhelő állítását puhította, okirati bizonyítékot megnevezni nem tudott, a gyanús szerződéseket állítása szerint ugyanis kidobta a szemetesbe.

A tanúmeghallgatás előtt Homonnai János ügyész Csapó Gábor olimpiai bajnok vízilabdázó korábbi meghallgatására visszautalva észrevételezte, hogy "személyes tapasztalatai" és az állampolgári jogok biztosa szerint a BKV nem tett eleget a fogyatékosokkal szembeni elvárásoknak. Ezzel a hozzászólással feltehetőleg azt a kínos helyzetet próbálta menteni, amibe a BKV-t népszerűsítő vízilabdázó meghallgatásán került. Az ügyész ugyanis korábban - a vádirattal egybecsengően - szükségtelennek nevezte a Csapó Bt. szerződését, amelynek bevételéből a sportoló fogyatékos gyermekek ingyenes sportképzését finanszírozta. 

Korábban az ügyész a tanúként meghallgatott olimpiai bajnoktól azt is megtudakolta, hogy milyen alapon használhatja az iskolájának otthont adó uszoda termeit. Csapó akkor általános derültséget okozva elmondta az ügyésznek, hogy elég sokan ismerik őt.

Takács Péter meghallgatása egyébként nehezen kezdődött, ugyanis az ügyészségnek ismételten változtatnia kellett a folyamatosan átírt vádiraton. Ezúttal néhány szerződés összegével összefüggésben írták át az ügyészek a vádat. 

Ügyvédi kérdésre válaszolva Homonnainak arra is felelnie kellett, hová lettek H. Éva össze-vissza dátumozott kihallgatási jegyzőkönyvei. A korábbi, Hagyóval kapcsolatban az ügyészség által elkövetett okirat-hamisításra hasonlító üggyel kapcsolatban a vádhatóság most "nem szándékos elírásokra" és "dokumentumok összefogására, elkeveredésére" hivatkozott. H. Évát nem elégítette ki a válasz, és Hagyó védőjéhez hasonlóan jelezte, a dátumok még mindig nem stimmelnek az iratokon.

BKV case: the prosecution quizzed an Olympic champion and a film director

On the Kecskemét Tribune on Thursday on the hearing of the BKV case, they heard as a witness Csapó Gábor who is an Olympic Champion and Kamondi Zoltán who is a film director. According to the standpoint of the accusation the sponsor of the sport and culture at the time of the former deputy lord mayor, Hagyó Miklós was unneeded and damage cause activity. Csapó’s Limited partnership signed with the BKV in 2008, with the value of 2,85 million forint. 

And Csapó placed the BKV’s molino in his swimming school, and with the help of the parents they worked on the BKV’S logo on the kid’s sport supplemental. The Olympic champion told, that in his swimming school he raised 20 thousand young kids in 20 years, including 50 handicapped young kids in a year, and for whom they ensured the participation for free.

BKV case: the prosecution investigated on a public page


The prosecution discovered a connection between one of the defendants and one of the witnesses of the BKV case on a famous public page, but because the concerned didn’t deny their professional connection the exposure became „pointless”.


On the Kecskemét Tribune on the Tuesday’s hearing of the Hagyó case which is called after Hagyó Miklós, the former MSZP politician who were the deputy lord mayor and the defendant I in the case, it turned out: they changed the basis of a few accusation so then the prosecution can verify their concept.

On the hearing, the court heard BKV’s subcontractor. The prosecution questions for the leaders of the companies’ trend to prove that a few of the communicational and marketing contracts were unneeded, but the standpoint of the prosecution didn’t have any confirmation. One of the witness said, that the BKV’S own apparatus would be unable to do the ordered graphic and other creative works.

Justice or No Justice: The Prosecution Manipulates the Indictment, Again
The trial of Miklós Hagyó and 14 other defendants continued in Kecskemét, Hungary on February 28th. During the hearing, the court witnessed another alteration to the indictment. This time, the changes were made to the alleged financial damage accumulated to the Budapest Transit Company (BKV). Unfortunately, the article from which I get this information does not detail the modifications. I would not be surprised if the prosecution and/or the Kecskemét Tribunal obstructs this information from the public.
The prosecution has already changed the charges in the indictment many times. In fact, defendants and followers of the case have dubbed the indictment the “political pamphlet.” This, no doubt, refers to the widely held belief that the case is show trial – a highly publicized trial in which the verdict is rigged. One cannot help but sympathize.
Out of curiosity, I briefly researched the possibility to change the original charges of an indictment in two other judicial systems which are usually considered “fair” and objective.
According to the Department of Justice’s website, it is generally forbidden to alter the original indictment charges in the United States. For example, the 1962 case of Russell v. United States yielded the opinion that if the original charges were changed or amended, then the defendant(s) “could then be convicted on the basis of facts not found by, and perhaps not even presented to, the grand jury which indicted him.”
In England, the Crown Prosecution Service’s website states that amending the indictment requires “an express order of the court to comply with s5(1) of the Indictments Act 1915.” Otherwise, the amendment is null.
Judicial law permits the alteration of original indictment charges in Hungary. I fail to see, though, how that supports a fair trial. If the prosecution can amend or draft new charges throughout the trial, why even bother to create an indictment in the first place?

The prosecution disapproved the latest report of the Népszava on the Thursday’s hearing of the Hagyó case on the Kecskemét Tribune. We wrote that on the hearing of the former BKV leader who gave opinions about the contracts what were signed at the time of the main defendant of the case, Hagyó Miklós (former deputy lord mayor), it turned out that the witness of the prosecution agreed her testimony with the present leader of communication at the BKV.

We also reported that the prosecution made the witness to give back the glucose (candy) what she got from Hagyó Miklós, because according to the prosecution it can be suitable to have the “sympathy pique” of the witness.


According to the prosecution the published article which came out during the break of the hearing could influence the witness with the comments of our article what they criticized and the similar phenomenon’s can effect in the future that the witnesses will pick their words. However the defendants – from them occasionally Hagyó – continually communicate, they socialize/touch with the reporters who are in the hearing, the prosecution thinks that behind the writing which can influence the witnesses is „Hagyó’s impact”.
Kádár András, the lawyer of Hagyó Miklós on the hearing indicated that he feels a twin standard in the observation of the prosecution. „They labeled my protégée as the number one public enemy, they outraged him in the nation media, but in that time they didn’t take the stand” – drafted the lawyer.

Kádár also remembered, that the character of the Népszava report, whom the prosecution disapproved of, the BKV leader who was heard as a witness wanted to be in the media herself, because she signaled in the crossfire of the cameras and of the photographers that they can make pictures and sound recording of her and she allows the usage of the records. 


The BKV case after the interact, continued with the hearing of the witnesses about what henceforward we will report – without bias, according to the letters of the records what is available on the internet (www.hagyomiklos.com). 

On Thursday’s hearing on the court they heard 3 leaders of companies what were signed for BKV’s PR communication tasks. According to the indictment the contracts were unneeded and unsubstantiated. After the Népszava, the prosecution had to hang up in their witnesses too, because according to them the BKV was unable to do it by itself, as the indictment said.

The defendants responded for the again revised indictment on the Thursday’s hearing of the Hagyó case on the Kecskemét Tribune. The prosecution several times revised the indictment which is already stands in weak legs, what Hagyó and his fellows during the investigation named it as „political pamphlet”. At this time they made the indictment softer in several places and now they are not writing about „orders” for unneeded contracts, now they are writing about „requests”. 
In the indictment the amount of the damage – not at first during the process – changed again and similarly with the before ones, the prosecution had problems with the math again. More of the defendant and their lawyers said that the part amount of a few contract does not bring out the whole amount of the damage. Because of this they proposed that the prosecution present itemized that with amount they charge with which defendant.

Z. Tibor defendant also said that in a big case like this the prosecution’s scuttlebutt place phrases in the indictment. With this he referred that in the „soft” indictment there is unusual shady/cloudy statement which says „they had to complete a request from an unknown leader of Budapest”. ” I never thought that in a strange story like this I will be the goldfish” – added Z. Tibor.
With the neediness of the communication contracts the defendants brought up the testimony of Bolla Tibor, who is the present CEO of BKV, when he said that for communication and marketing the transportation company still spends money. However the prosecution in the revised indictment states that the BKV has no concurrency, L. Otto defendant in his observation listed 11 path/line and alternative solution in the case of if „he has to go to the honored investigation prosecution” from his home.

On the Thursday’s hearing they heard the leader of the communication, Székelyné Dr. Pásztor Erzsébet, who is in this position at the BKV up to this day. Székelyné changed her testimony what she said years before with not remembering that she would have notice any signs for malfeasance with the defendants. She only alluded to the reason of the loosing of the trust is just that Kocsis István prosecuted in the case of the BKV contracts. From that matter Kocsis after his nomination as the CEO of the BKV proposed a leader position to Székelyné who now confirmed the standpoint of the defendants, which said that the BKV needed and still needs for communication and that the company is not monopoly in the field of the transportation of Budapest. She remembered for Z. Tibor defendant, her former employee as a scrupulous/conscientious labour/manpower.

A vádirat újabb módosítására reagáltak a vádlottak a Hagyó-per csütörtöki tárgyalásán, a Kecskeméti Törvényszéken. Az ügyészség már többször hozzányúlt a gyenge lábakon álló vádhoz, amit az eljárás során Hagyóék "politikai pamfletnek" neveztek. Ezúttal több helyen puhították az irományt, és már nem szükségtelen szerződéskötésre adott "utasításokról", hanem "kívánságokról" írnak.
A vádiratban a károkozás összege - nem először az eljárás során - ismét változott, és a korábbiakhoz hasonlóan az ügyészségnek ismét meggyűlt a baja a matematikával. Több vádlott és védő jelezte, hogy az egyes szerződések részösszegei nem adják ki a teljes kár összegét. Emiatt indítványozták, hogy az ügyészség tételesen mutassa be, pontosan mekkora összegű károkozással vádolja az egyes vádlottakat.

Z. Tibor vádlott azt is szóvá tette, hogy egy ilyen súlyú ügyben az ügyészség mendemondai kitételeket helyez el a vádiratban. Ezzel arra utalt, hogy a puhított vádiratban szerepel olyan szokatlanul homályos állítás, amely szerint "egy ismeretlenül maradt fővárosi vezető kívánságát kellett teljesíteni". "Sosem hittem, hogy egy ilyen különös történetben én leszek az aranyhal" - tette hozzá Z. Tibor.
A kommunikációs szerződések szükségességével kapcsolatban a vádlottak felidézték Bolla Tibor, jelenlegi BKV-vezér vallomását, amely szerint marketingre és kommunikációra ma is költ a közlekedési cég. Bár az ügyészség a módosított vádiratban is azt állítja, hogy a BKV-nak nincs konkurenciája, L. Ottó vádlott tizenegy útvonalat és alternatív megoldást sorolt fel észrevételében arra az esetre, ha otthonából "be kellene fáradnia a tisztelt nyomozó ügyészségre".

A csütörtöki tárgyaláson tanúként meghallgatták a BKV mai napig a posztján lévő kommunikációs vezetőjét, Székelyné Dr. Pásztor Erzsébetet. Székelyné évekkel ezelőtt tett vallomását némileg megváltoztatva már nem emlékezett arra, hogy észlelt volna visszaélésre utaló jeleket a vádlottakkal kapcsolatban. A velük szemben tanúsított bizalomvesztése indokaként csupán arra hivatkozott, hogy Kocsis István feljelentéseket tett a BKV-s szerződések ügyében. Kocsis egyébként vezérigazgatói kinevezése után vezetői állást ajánlott Székelynének, aki most megerősítette a védelem álláspontját, amely szerint kommunikációra szüksége volt és van a BKV-nak, és nincs a cég monopolhelyzetben a budapesti közlekedés területén. Z. Tibor vádlottra, korábbi beosztottjára lelkiismeretes, terhelhető munkaerőként emlékszik.
