The Magical Nokia-box - part 18.

Is the public media biased towards the BKV-case?

The government of Fidesz passed the new press and media act. In the Media Council established under the new act there is no a single member who could be supposed to be in favour of the independent press. Although, it is the main responsibility of the MTI to provide the press with the latest and objective news, in the communication having been provided by them in relation to the BKV-case important bits of information have been lost. In most of their reports the focus is more on the details of the older testimonies which have already been unsaid in most of the cases. At many points they have penned briefly and ambiguously, furthermore their titles have not reflected accurately the events took place during the trials.

Has the public media given up being independent?

The new press and media act issued by the government of Fidesz and the omnipotent Media Council elected for 9 years provide this impression. Since its being passed the act has been heavily and justifiably criticised both at a nationwide and an international level. Negative opinions have been expressed worldwide on the current status of the Hungarian democracy and “freedom” of the Hungarian media by the leading newspapers, diplomats and political organizations.

The Magical Nokia-box - part 9

How did the Nokia-box effect the parliamentary elections?

The smear campaign against Hagyó had significant role in the two-thirds victory. The new Fidesz-led government appointed Tünde Handó as the president of the National Office for the Judiciary, Péter Polt as the Chief Prosecutor of Hungary, Mária Szívós as signatory judge, furthermore they established their authority over the media with the help of the media law. As the Nokia-box had an influence on the election, the election also had an effect on the Nokia-box case, as the above mentioned appointees played a significant role in the progress of the BKV- and Hagyó-case.

Thanks to the Nokia-box legend has the left-party been associated with corruption?

Yes, it has. After Zsolt Balogh’s statement the whole nation was shocked. At the time of the 2010’s election the Nokia-box became the symbol of corruption in the public awareness. The idea of a corrupt, left-liberal and rotten government developed by the right-party related media seemed to be proved for people criticizing the Gyurcsány-government. As a result of the smear campaign the left-party not only lost the elections, but Fidesz was able to obtain the two-thirds majority.

The legend of the nokia-box and the pure truth - part 6

A news came to light in the Hungarian media in March 2010 which shocked the whole country. This served the proof to the ones who criticize the Gyurcsány-government that the socialist-liberal administration is rotten to the core. This prejudice has been created successfully by the right-wing media.

Summarizing my standpoint regarding the confessions of the accused of IV order it can be stated that the prosecutor raised accusation against Hagyó only upon the statement of Balogh which is full with contradictions and discrepancies. The prosecutor found the above statements profound despite of the fact that the contradictions between the confessions have to be clarified due to the relevant regulation and stipulation of the criminal procedure act. It is, as shown above, is still missing for some reason.
We cannot talk about evidences which would serve the basis of the prosecution. According to the rules of criminal procedure the fact which is not proven shall not be considered against the accused.

The failed recognition of the alleged eyewitness

Zsolt Balogh testified on 23rd August 2010 that Hagyó sent him to Gödöllő to his girlfriend, Krisztina T. where he instructed Balogh to give him 15 Million per year. Due to the confession of the accused of IV order that Hagyó told him that there are two reasons: the first on is that he works with a bunch of fellows who are not registered employees but they have to be financed and the other reason was that there is a nursing home at Csepel and he collected the money to support it". Here, again he accuses Hagyó that he threatened him with the disclosure of the improper CC Soft statement on completion.

Krisztina T.  stayed in the second room when Balogh and Hagyó met so she could detect only the tone of the conversation tone detected, she did not hear what was said. That is the reason why she said that the conversation took place in a calm, polite manner and it did not seem to be such a violent persuasion or coercion.

Miklós Hagyó’s girlfriend, Krisztina T.’s photo was shown to Zsolt Balogh during the investigation. It is strange that the accused of IV order did not recognize Krisztina T. however he stated that they met during the meeting in Gödöllő. It is difficult to understand that someone with strong emotions in connection with a memory can provide a detailed report but continuously failed to recognize a person taking part in that event.

On this basis, it is concluded that Zsolt Balogh’s statement is improper to confirm the II point of the indictment and no additional evidences arisen. In the light of this it is incomprehensible that how the prosecutor raised claim. Why a person was held in pre-trial detention, exposed to severe testing whose guilt is not supported by anything?

They didn’t inform me about serious elements

However the news agency (MTI is the Hungarian news agency) reported in detail about the happenings on the BKV case, most of their reports were typical, that they placed the tone onto the old testimonies, and for that they already renounced these statements, most of the time they just mistily alluded to.

The MTI (News Agency of Hungary) for example didn’t report that according to the testimony of Mesterházy Ernő, the former main advisor of Demszky Gábor the investigation authorities humiliated him, and they convinced him to take an incriminatory testimony against Hagyó Miklós, and if he does they will let him go from the pre-trial detention.
