Are there any cases related to Miklós Hagyó which were closed?

In spite of the obvious partiality four cases related to the Magic-box were closed. It was proved before the court that in the pre-trial detention Hagyó did not commit falsification of private documents related to his registered partner’s visits. Related to the lockup of his wealth the court decision was made in his favour. The investigation initiated based on the report made by the State Audit Office was dropped, furthermore the Court of Human Rights in Strasbourg decided in Hagyó’s favor against the Hungarian state in connection with the conditions of his custody.

How many proceedings have been closed in favor of Hagyó?

Currently the BKV-case the legal state is 4:0 in favor of Hagyó since the investigation initiated based on the report made by the State Audit Office was dropped by the Prosecution Office. It means that in all the four cases the court decided in favor of Hagyó in spite of every effort made by the prosecution.

Did Miklós Hagyó admit the charges against him?

The moment when Miklós Hagyó gave his testimony before the Court of Kecskemét was waited for impatiently by the media and the public as well. In his testimony Hagyó rejected the charges brought against him including the Nokia-box related statements. Moreover he drew the attention of the court to more inaccuracies in the indictment. In the indictment more dates are inexact and it was compiled without questioning him or other executives involved in the case about the Nokia-boxes during their pre-trial detentions.


Why did not the indictment fulfil the formal requirements?

The crime of bribery and blackmail described in Count II of the indictment is too general; also it fails to refer to the exact location and time of the delivery, in other word the situational elements necessary for the concretization are missing from the document. Therefore the charges against Miklós Hagyó which are related to the Nokia-box do not fulfil completely the requirements of the legal criminal procedure, which would ensure that the prosecution be brought only based on proven and concrete facts of the case filed accordingly in the Indictment. However, there are issues concerning the provability of the indictment, as the interrogatees reported the influence of the investigatory statements.

Miklós Hagyó's detention issue is quite simple. After reviewing the available documents here, anyone can decide - at least imposed on itself - whether the prior arrest of Miklós Hagyó is consistent with the Hungarian laws or even with basic common sense of ordinary logic.

On the ground of the published media reports probably was difficult to follow exactly what the case is about, therefore we tried to easily summarize with the facts of the accusation and clearing, we analyzed the law background of the case, and finally we discussed the solicitous in connection with prosecutor's procedure.

The Pre-trial Detention and the Strasbourg Court of Human Rights

I have written that Miklós Hagyó was subjected to a 9-month term in pre-trial detention, which is one of the more controversial aspects of the entire affair. Apparently, though, I am not the only person who considers the pre-trial detention circumstances lawfully questionable. 
Hagyó recently petitioned the Strasbourg Court of Human Rights (SCHR) to consider his case with regards to the legality of his time spent within the penal institution. After receiving Hagyó’s plea, the SCHR has essentially agreed to review his case, and subsequently has asked the Hungarian Ministry of Public Administration and Justice to lay forth their claims on this case.

The “Hagyó Case” is an all-around scandalous affair. Billions of Hungarian forints, which were “public” money, were allegedly misused. Politicians and business men alike are pointing accusative fingers or throwing their respective hands up in seemingly innocent defense. 



And though the Hungarian judicial system has yet to determine this from that within this moral conundrum, one conclusion has been simple: Some people profited at the expense of Miklós’s time in pre-trial detention. I mentioned Balogh Zsolt’s suspect promotion in my last post. Another woman professionally progressed, perhaps, even further.

Did the Hungarian authorities derogated/bruised the rights of Hagyó Miklós?
Hagyó Miklós was arrested in 14th of May, 2010, and then they ordered his pre-trial detention. Since the defense started to make reasons beside/along the needless of the pre-trial detention, the Hungarian court both in the court of the first instance and in the court of the second instance left out of consideration, Hagyó Miklós turned to the European Court of Human Rights for remedy.

In his petition beside his harm for his right in freedom and security (European Convention on Human Rights 5ft clause) he also asked remedy for the violation of the inhuman treatment surreptitious (Convention 3rd clause), with the correspondence of his circumstances of his detention, together with the harm of his right of the family life (Convention 8th clause) seeing that they controlled/restrained wrong his talking with his partner, and they didn’t considerate/take in account his daughter’s state of health/shape while he was in pre-trial detention.
The petition was investigate by the Court, and they decided that – because apparently it couldn’t be unsubstantiated – they will communicate the content of it with the representative of the Hungarian State with the Ministry of Public Administration and Justice. The ministry had to form/configure their standpoint about the facts in the complain and send it to the Court by 18th of September, 2012.
After this Hagyó Miklós, as the petitioner get a chance to respond for the ministry’s standpoint until the time what the Court will decide, then again the Hungarian government can observe the reasons of the petitioner.
According to the main rule, the Court after this on the strength of the documents what they have and the reasons, they will have a decision about the petition. As long as they adjudicate that Hagyó Miklós’s right what he marked/labeled in his petition (or a part of it) was derogated/bruised by the Hungarian authorities, they can over the finding/proving of the fact, they can adjudicate asset/money and non asset damage for his suffer harms.

Hagyó Miklóst 2010. május 14-én őrizetbe vették, majd elrendelték előzetes letartóztatását. Mivel a védelem által az előzetes letartóztatás szükségtelensége mellett felhozott érveket a magyar bíróságok mind első, mind másodfokon rendre figyelmen kívül hagyták, Hagyó Miklós az Emberi Jogok Európai Bíróságához (Bíróság) fordult jogorvoslatért.

Kérelmében a szabadsághoz és biztonsághoz való jogának (Emberi Jogok Európai Egyezménye, 5. cikk) sérelme mellett orvoslást kért az embertelen bánásmód tilalmának (Egyezmény, 3. cikk) megsértése miatt a fogvatartásának körülményeivel összefüggésben, valamint a családi élethez való jogának (Egyezmény, 8. cikk) sérelme miatt arra tekintettel, hogy alaptalanul korlátozták az élettársával való beszélőit, és nem vették figyelembe kislányának egészségi állapotát az előzetes letartóztatás fenntartása során.
A kérelmet a Bíróság megvizsgálta, és úgy döntött, hogy – mivel nem tekinthető nyilvánvalóan megalapozatlannak – annak tartalmát kommunikálja a magyar államot képviselő Közigazgatási és Igazságügyi Minisztériumnak. A minisztériumnak 2012. szeptember 18-ig kellett a panaszban foglaltakkal kapcsolatos álláspontját kialakítani és a Bíróságnak megküldeni.
Ezt követően Hagyó Miklós mint kérelmező kap lehetőséget arra, hogy a Bíróság által megszabott időn belül reagáljon a minisztériumi álláspontra, majd ismét a magyar kormány észrevételezheti a kérelmezői érveket.
Fő szabály szerint ezt követően a Bíróság a rendelkezésére álló iratok és érvek alapján döntést hoz a kérelemről. Amennyiben úgy ítéli meg, hogy Hagyó Miklósnak a kérelemben megjelölt jogait (vagy azok egy részét) a magyar hatóságok csorbították, e tény megállapításán túl vagyoni és nem vagyoni kárt is megítélhet neki az elszenvedett sérelmekért.

Hagyó Miklós turned to the European Court of Human Rights, because he thinks that the Hungarian investigation who restrained him, did multiple trespass – reported the Blikk (it’s a Hungarian newspaper).

According to the former deputy lord mayor, the Hungarian investigators who restrained him, violated a lot of item/clause from the European Convention on Human Rights, so the support of the legal freedom and security, the restraint of the inhuman treatment, and the legal of the family life. According to Hagyó he says that he was in pre-trial detention wantonly/unduly, and it was extended a lot of times, despite his failing state of health/shape. 
According to his testimony „he never even thought to escape to abroad” and from the beginning he co-operated with the investigations. The former politician torted/offended that they alluded to the danger of collusion by time they prohibited that his partner could visit him more times that the regular visiting time. Hagyó was in pre-trial detention for 10 months, after this they put him into house arrest. The court of Strasbourg said that Hagyó’s petition can be established/valid, so they asked the Ministry of Public Administration and justice to respond for the complains.

As it known, Hagyó Miklós is charged with continually, commited in a criminal organization, misappropriation which caused an especially huge financial detriment as an instigator, furthermore, with the crime of bribery/corrupt practices, what he did twice against 2 functionaries, with the crime of malfeasance, together with the crime of blackmailing a functionary. The case was relocated by the National Court Office’s president, Handó Tünde (who is the wife of Szájer József, the representation of EP, Fidesz party) to the Kecskemét Court. The Kecskemét Court before convicted here the former MSZP politician, Zuschlag János. A lot of defendant and their defenders thinks this relocation was wrongdoer/against the law, and they made a petition for the Constitutional Court.

A volt főpolgármester-helyettes szerint ugyanis az őt fogva tartó magyar hatóságok megsértették az Emberi Jogok Európai Egyezményének több cikkelyét is, így a szabadsághoz és biztonsághoz való jog biztosítását, az embertelen bánásmód tilalmát, illetve a családi élethez való jogot. Hagyó szerint indokolatlanul helyezték előzetes letartóztatásba, és hosszabbították azt meg többször is, romló egészségi állapota ellenére.
Állítása szerint ugyanis "esze ágában sem volt külföldre szökni", és a kezdetektől együttműködött a hatóságokkal. Az egykori politikus azt is sérelmezi, hogy összebeszélés veszélyére hivatkozva idővel megtiltották, hogy élettársa a rendes látogatási időn felül is bemehessen hozzá. Hagyó mintegy 10 hónapig volt előzetes letartóztatásban, ezt követően helyezték házi őrizetbe. A strasbourgi bíróság szerint Hagyó beadványa megalapozott is lehet, ezért felkérték a Közigazgatási és Igazságügyi Minisztériumot, hogy reagáljanak a panaszokra.

Mint ismert, Hagyó Miklóst folytatólagosan, bűnszervezetben elkövetett, különösen nagy hátrányt okozó hűtlen kezelés bűntettével mint felbujtót, továbbá kétrendbeli, vezető beosztású hivatalos személy által elkövetett vesztegetés bűntettével, hivatali visszaélés bűntettével, valamint hivatalos személy által elkövetett zsarolás bűntettével vádolja a vádhatóság. Az ügyet az Országos Bírósági Hivatal elnöke, Handó Tünde (Szájer József fideszes EP-képviselő felesége) helyezte át a Zuschlag János volt MSZP-s politikust is elítélő Kecskeméti Törvényszékre - több vádlott és védőik szerint jogsértően, emiatt alkotmánybírósági beadványt is tettek.

The Hagyó Case - The Operations of the Hungarian Judiciary and the Media in Practice

Within the last month the work of the Hungarian government received a lot of criticism from Europe and the United States. The world's leading journals, diplomats and political organizations drafted a definite opinion about Hungarian democracy. Most often the observations were about changes of the jurisdiction since the Fidesz won the elections with two-thirds (clear majority) in 2010, and Orbán Viktor was voted into the executive power of the Prime Minister position.

On the May 5th, 2012, Thomas O. Melia who is the U.S. Deputy Secretary of Foreign Affairs gave an interview to the Hungarian TV channel, ATV, and he said that the media and jurisdiction situations are solicitous. The Freedom House relegated Hungary from the free category to the restricted free. The attitude of the Fidesz was well represented by Deutsch Tamás, a member of the European Parliament, on his official Twitter page. He wrote about the U.S. Deputy Secretary of Foreign Affairs, "Who the fuck is Thomas O. Melia?” When asked by a journalist about his comment he answered that his response was funny. A (from the scope of basic constitutional rights) special case?

Despite the fact that according to the law in our country everyone is equal , the practice shows that today there are ,,less equals." Our current basic law - similar to our pre-existing constitution - listed in basic constitutional rights the rights of fair trial to which everyone is equally entitled. 

Of course, this fundamental principle of law does not foresee any exceptions, because such a sentence is declared in a democratic constitutional state under the Basic Law would create astonishment. Thus the so-called priority issues of the Basic Law does not consider from the scope of ,, priority " The BKV case of the third-order suspects, Miklós Hagyó case however questioned by experienced this apparently obvious conclusion.

Was Hagyó’s detention violation of law?

The circumstances of Hagyó Miklós, the ex socialist deputy major ’s preliminary detention violated several section of the European Convention of Human Rights., according to the documents are published on the www.hagyomiklos.com.




The prosecutor has not presented those data yet, according to that Hagyó’s intention is to leave the country, moreover the condition of the most strict coercive measure in the convention did not come true. There was not any answer for the complains, and the judge who delivered judgement against Hagyó and his partners, now he is in the Constitutional Court with Fidesz support.
