What are the expected consequences of the court decision?

I connection with the court decision considered to be “too lenient” the Fidesz wanted to call the judicature to account, however the high ranking representatives of the judicial power – involving Tünde Handó – have protested against it. The events took a dramatic turn when more judges making statements anonymously admitted that no independent judiciary exists in Hungary and the judges are exposed to the influence of their superiors. Definitely, this explains a lot in connection with the highly questionable decisions made in the BKV-case in the investigatory phase.

How did the MSZP turning their back on Hagyó react to the court decision?

After the court acquitted Hagyó of the most serious charges, the MSZP took the former socialist Deputy Lord Mayor under their protection. Better late than never, right? Well, since the story broke this was the first time that the socialist stood by their ex co-member having been dragged through the mire. Gergely Bárándy, the socialist vice-President of the legislative board stated that the charges were unfounded, they were lies. There was no Nokia-box, there was no corruption and there were no bribes. He also mentioned it more times that the Fidesz tries to increase their support by initiating show trials and unfortunately, they can always find people at the Prosecutor’s Office who are happily willing to provide assistance to the Fidesz with its methods associated with the “darkest dictatorships”. Gyurcsány referred to the Nokia-box as a smart marketing trick in an ATV program.

According to the MSZP the Fidesz is trying to increase their support by initiating show proceedings and they can find people at the Prosecutor’s Office who are happily willing to provide assistance to the Fidesz with their methods associated with the “darkest dictatorships”.


Gergely Bárándy, vice-president of the socialist legislative board of the Parliament stated: during the criminal procedure brought against Miklós Hagyó, former socialist Deputy Lord Mayor, and his co-defendants, it turned out that the charges were groundless lies. There was no Nokia-box, there were neither bribes nor corruption. Those who have provided assistance with the show trial were rewarded: for example the prosecutor bringing charges against Miklós Hagyó became István Tarlós’s, Lord Mayor’s chief advisor.

According to the lawyer of Miklós Hagyó, ex-Deputy Lord Mayor of the socialist party - having been sentenced to suspended imprisonment – there is a direct twofold connection between the Nokia-box, the memento of the BKV-scandal reaching its peak during the parliamentary election period in 2010 and the win of the currently governing parties with two-third majority. According to the election expert answering to our questions the corruption case did contribute to the uncertain voters’ deciding for the right-wing.


Based on the sentence passed by the court of first instance at the beginning of the week none of the accused in the Hagyó-case has to go to prison, what is more some of them are entitled to bring an action for damages. Three of the four charges against the first accused, former Deputy Lord Mayor, have been dismissed by the court. However, for abuse of authority and breach of fiduciary duty he has been sentenced to tow-year imprisonment suspended for four years.

Did the Nokia-box case influence the municipality elections?

Of course, it did – Hagyó was suspected of the Nokia-boxes five week before the municipality elections. This was also the time when the records on the confrontation leaked out, which brought back the same public mood as before parliamentary elections. In fall – just like previously in spring before the parliamentary elections - the Nokia-box became a campaign topic again. Beginning a new wave of their attacks they used the BKV-severance pays as weapons. Later more socialist politicians were charged. The then mainly liberal and socialist Budapest failed. Although it has been revealed that the Nokia-box charges are false, the truth cannot change the results of the elections.

When and how did the record on Balogh and Hagyó’s confrontation leak out?

Again the timing of the right wing was careful and precise. The record on the police confrontation came to light during the campaign period of the elections. And although it is obvious it should be pointed out that the Magyar Nemzet did publish it under the following title “I live in fear of death by you, Miklós!”. Of course, the fact that the BKV-case was picked up again might have influenced the municipality elections as it might have done the parliamentary elections.

The prosecutor getting Hagyó into custody is also one of Tarlós’s chief advisors


The former prosecutor who succeeded to have the former Deputy Lord Mayor of MSZP in custody appears on the list of Tarlós’s advisors by the name of her husband’s with a monthly salary of 850 thousand forints. Former counter intelligence agents and police officers involved in the BKV-case are employed by the capital city, as well.



One of the Lord Mayor’s most well-paid chief advisors is Péter Ottóné Szabadvári dr. The lawyer currently using his husband’s name at the City Hall worked as prosecutor by the name of Katalin Vámos: she was involved not only in the Hagyó-case but also in proceedings against more executives in Budapest. Her name also appears in cases of breach of state-secrets and in the cases in connection with the UD Ltd. She is not the only one who took a role in these cases and became employed by the capital after Tarlós had been elected.

On the salary list published by the Origo a couple of weeks ago the most well-paid advisor in the 14-member advisory team appears by the name of her husband, Péter Ottóné Szabadvári dr. The chief advisor working as special referee for a monthly salary of 850 thousand forints was identified by the Origo as the former prosecutor who had played an important role in the Hagyó-case.

How did Hagyó react to the scandal?

The press was emphasizing that BKV-case would be Hagyó’s downfall. Fulfilling MSZP’s request the Deputy Mayor resigned from his positions. He said that he did not want to weaken the left-wing with his own battle. He also added that time and justice are good friends and he could face with both of them.



Why did Hagyó fulfill the request of the capital presidency?

Who wins with the scandal?


The case came in handy to FIDESZ before the elections. They turned almost immediately to the Attorney General, 6 days after the scandal burst out. Everyone who may be familiar with the Hungarian political situation knew that BKV-case was very important with regard to the 2010 national elections. Hagyó resigned from BKV supervisory board in August, 2009. MSZP announced that they trust in the innocence of the Deputy Mayor but on the contrary they asked Hagyó in February, 2010 - in the middle of the election campaign - to resign from every title he had.




 If MSZP trust in Hagyó’s innocence, why did they have him resigned?

Knowing the position fights inside MSZP it is not surprising that the national management did everything possible to shrivel Hagyó from the fourth place of the regional list. They were insinuating and leaking in the press however they claimed Hagyó to resign only when it was published that two BKV managers took incriminating testimony against him.

The bill submitted by MSZP not long ago would punish official people with the possibility of 10 years imprisonment – that way also the prosecutors and the investigators working on the BKV case – who produce made-up evidences or if they participate in this action with malfeasant tools.





The defendants and witnesses involved in the BKV case during the hearing reported one after the other that they’ve made their previous testimonies which were incriminatory to others under humiliating circumstances, directionally, coercion interrogations as a result of the interrogating investigators’ and policemen’s threats.

Even Zsolt Balogh, the case’s key witness and at the same time defendant also admitted that the reason behind his incriminatory statements (for example about the Nokia box) during the election campaign was that he wanted to meet the expectations and to avoid jail. “I’m not a hero, I didn’t want anything else just to go home” – he confessed before the court.

The MSZP Local Governments, host children from Transylvania


So far, more than 200 children received accommodations in Hungary. Local socialist governments shall give accommodation to flood stricken families’ children in the near future. The Party has offered a $ 1 million donation to the Hungarian Red Cross to aid the flood-stricken inhabitants of the municipalities.

Miklós Hagyó announced that the children from Székelyudvarhely, Galambfalva, Farkaslak, Siménfalva, Korond, Bikafalva, and Bögöz, will be coming to Hungary.




Party executive Istvan Hiller, related that if the rainfall in Transylvania continued, the Socialist Government would call upon the assistance of the Hungarian Red Cross and ask them to promote the popularity of their bank account for donation purposes.

I have written extensively about the BKV case and the severance payment scandal in addition to the current case against Miklós Hagyó. However, the two cases, though connected to the same company, involve very different alleged crimes and suspects. Since Mrs. Eleonóra Szilágyi Szalai was the original suspect for receiving misappropriated funds, how did Mr. Hagyó become involved? The answer lies within the words of one man.
Balogh entered BKV in April 2007 as an Investment Manager which required of him to oversee the preparations and executions of new projects. A short while later in October 2007, he transferred to the position of Deputy Engineer Manager and Under Secretary to the acting Director Attila Antal. After Attila had fallen seriously ill, Balogh was promoted by the BKV Board of Directors to serve as the Interim Director of the public transportation company in February 2008. According to a source familiar with the public company, there were 15 board directors: nine members from SZDSZ, another four were from MSZP, and the remaining two were appointed by the MSZP government. Mr. Balogh served as the Interim Director until September 2008 when István Kocsis was elected by the Board of Directors to act as full-time Director. At that time, Balogh worked as Kocsis’s right-hand man.
As a result of Balogh’s public accusations that Miklós was involved in bribery and misappropriation of public funds, Miklós was detained by the Budapest Police. Even though no formal investigation had been conducted, the only evidence for the alleged crimes were the public statements made by Zsolt Balogh, Miklós was subjected to pre-trial detention.
While Miklós’s pre-trial detention was maintained without supporting evidence by Judge Mária Szívós, Zsolt Balogh was given full-control over the Public Transport Company in Pécs, a beautiful city of around 160,000 people in southwestern Hungary. This promotion has been noted by many as peculiar considering Balogh’s upper-management roles at BKV during the severance payment scandals. Further speculation has arisen from Balogh’s skeptics since Pécs’s local government is controlled by the Fidesz party.

On Wednesday, I said that I was going to make a summary post about my blog, The Hagyó Case.  I want to do this for a couple of reasons.  Firstly, the blog’s readership has increased about 30% over the past week, which is great! Appropriately, I’d like to recap the evolution of the story for those who have recently started following.  Secondly, the story is full of confusing details about the legality of contracts and whether or not those contracts contributed to the financial gain of an alleged criminal organization. I have described the intricacies of the contracts in previous posts, and I will continue to relay the information from subsequent court hearings.  For now, I only want to provide the back story.
In 1998, a successful and wealthy businessman by the name of Miklós Hagyó (Me-klosh Ha-djo) joined one of Hungary’s dominant political powers, MSZP (Magyar Szocialista Párt – Hungarian Socialist Party).  Over the next twelve years, he would climb the political ladder to become a deputy mayor of Hungary’s capital city, Budapest, and a member of parliament.  Within his deputy mayoral capacities, Hagyó supervised the public transportation system of Budapest which is aptly translated as Budapest Transit Company (BKV).  Although Budapest’s public transport system is well-used, the company was annually taking a financial beating.  For example, in 2007 and 2008 the company was publicly indebted over 100 billion forints.  As I type, that is almost 470 million US dollars.  How did the company stay afloat? As I said, they were indebted to the public which translates into the government repeatedly bailed out the company. As a government subsidy, BKV’s business practices were under the watchful eyes of state institutions like the State Audit Office of Hungary, who noticed an employee severance payment scandal which I wrote about here.
Miklós Hagyó was not connected to the severance payment scandal, but it was the spark which lit the fire that was to become the political downfall and eventual imprisonment of the former prominent politician and humanitarian.
In March 2010, a former CEO of BKV by the name of Zsolt Balogh gave two interviews, one to Magyar Nemzet (Hungarian Nation) and another for HírTV.  During these interviews, Balogh stated that shortly after his promotion to CEO Hagyó invited the new executive to his office for what presumably would be a quick professional introduction.  However, according to Balogh, upon entering the office Hagyó was using both of his hands to stuff himself with 40 ounces of cold meat.   Then, he allegedly proceeded to tell Balogh “things must be done around here, and those who do not do it will receive no mercy.  Their throat will be cut.”  After that, Balogh claims Hagyó demanded an upfront payment of 15 million forint (more than $70,000.00 at the time of writing [ATW]).  Furthermore, he would annually need to pay that amount to Hagyó.  According to Balogh, the next day he obliged by giving Hagyó the 15 million forints which were hidden inside of a Nokia phone box designed for packaging.  The former CEO also claimed that he passed around 70 million forint (more than $328,000.00 ATW) to Hagyó over the course of a year.
Quite naturally, one should wonder from what financial source did Balogh pay Hagyó.  Well, this is where the tricky contracts come into play.
The prosecution claims that Hagyó sat atop a criminal organization with BKV’s senior management serving as his loyal henchmen.  The upper management’s purpose was to organize BKV’s business with other companies that were privately or professionally connected to the deputy mayor.  Once the contracts were created and the money was paid out Hagyó allegedly extorted the contract revenues from the managers.
After Balogh made the public statements, Hagyó became the disgraceful symbol of political corruption in Hungary. As a result, the former deputy mayor and member of parliament stepped down from his respected positions. A few months later in May 2010, the general elections occurred, and due to his prior resignation   he had lost his penal immunity. The police arrested him immediately following the governmental change. On May 14, 2010, after a few days of police interrogation, the court sentenced him to pretrial detention.  The prosecutors claimed they possessed evidence which strongly suggested Hagyó intended to flee the country in an effort to avoid legal troubles.
Miklós Hagyó passed nine months in pretrial jail, but due to deteriorating health he spent many months in the prison hospital.
The prosecution spent nearly three years in an attempt to gather enough evidence to put Miklós and 14 other people in jail.  Some presume that the investigators were trying to find evidence which would have connected the allegedly embezzled money to the Hungarian Socialist Party, who just happens to be the political rival of the currently governing Fidesz party.
Regarding the pretrial detention, Miklós’ lawyer requested access to the evidence which was “substantial” enough to keep him in jail for nine months.  Neither the prosecution nor the judge ever provided the evidence, citing that it would jeopardize the “integrity” of the investigation.
The trial is currently on hold for about a month.  So far, the biggest twist has been Zsolt Balogh’s in-court testimony.  He retracted his accusations, saying that the investigators coerced him into accusing Miklós of these crimes.  If he did not oblige to their demands, he would have had significant problems.
Many people might wonder why I chose to create a blog about this case.  I find the story to be morally and socially stimulating, but apart from that I felt that Miklós’ story should be told to the world outside of Hungary. According to BKV’s financial records, much of the work from the controversial contracts benefited the company.  Financially the company was spending less money, yet it was developing the transportation system. The prosecution has also admitted this to be true.
Why, then, is Hagyó accused of running BKV as a criminal organization from which he extorted billions of Hungarian forints?  There are a few different theories to that question.  A particularly strong one suggests that the socialists’ opposition, the Fidesz party, used him as a political pawn to turn the Hungarian populace against the socialist party.  In doing so, they could regain control of the Hungarian government.  Well, they did in May 2010.
Amongst all of the confusing uncertainties of the Hagyó case, one thing is profoundly true.  If the current government of Hungary is willing to manipulate a person’s life, especially the life of a regionally powerful person, then they can do that with anybody.  That is why I have chosen to write about Miklós Hagyó.

Hajdu László, the former socialist mayor of the 15th district of Budapest at the time of the local government election in 2010 in his statements in different medias he several times concerned/said things about Hagyó Miklós’s personality, and against him he said statements which harmed his personal rights.
In September, 2010 Hagyó prosecuted Hajdu in the Court of Central Pest with the charge of continuous libel with ignominious reason in public, he caused notable harms. The case ended on Friday.
According to his statement from 11th of January,2013, what can be found on the hagyomiklos.com website which is engaged with the Hagyó case. In the statement Hagyó and Hajdu aspired to arrange this case in peace and soothing/calmly for both of them, and for this to happen Hajdu apologized to Hagyó who at the same time dropped the accusation against Hajdu.


From the accusation what Hagyó did, it’s turned out that Hajdu said his previous statements without any basis. His first unreal statement came out on the 13th of August, 2010 in Népszabadság in an article called „Hagyó Miklós hold/got in his hand the MSZP people from Budapest”. The interview’s topic is already unreal, because when it came out Hagyó was already in pretrial detention since months, and as it known, as the circumstance of the BKV case explosion the MSZP asked him to back out/stand out. The Presidency of the Hungarian Socialist Party of Budapest told him to resign from his individual nomination and from his title in the list of Budapest and as a representative in local government of Budapest.

So Hajdu László admitted that against Hagyó Miklós he made statements which are wrongdoer. And however from the common statements they count this as closed but 2 things should be noticed. On one part, that apropos of the statements of Hajdu László what he made in the media, no one made any accusation against the former deputy lord mayor (not even Hajdu), no process started against him because of that (of course because the authorities didn’t find any valid reason) and on the other part that the statements not just were insulting, but they weren’t even true.

Ahogyan az a Hagyó-üggyel foglalkozó www.hagyomiklos.com nevű honlapon megtalálható 2013. január 11-ei nyilatkozatból kiderül, Hagyó és Hajdu is arra törekedtek, hogy az ügyet békés, és mindkét fél számára megnyugtató módon rendezzék, ennek érdekében Hajdu elnézést kért Hagyótól, aki ezzel egyidejűleg ejtette a vádat ellene.

Hagyó egykori feljelentéséből kiderül, hogy Hajdu korábbi állításai minden alapot nélkülöztek. Valótlan állításai első körben a 2010. augusztus 13-án, a Népszabadságban "Hagyó Miklós a kezében tartja a budapesti MSZP-seket" címmel megjelent cikkben láttak napvilágot. Az interjúnak már maga a címe is irreális, ugyanis a megjelenésekor Hagyó már hónapok óta előzetes letartóztatásban ült, s ahogy az ismeretes, a BKV botrány kirobbanásának következményeként az MSZP visszalépésre kérte fel őt. A Magyar Szocialista Párt Fővárosi Elnöksége felszólította, hogy mondjon le az egyéni jelöltségéről, továbbá mind a fővárosi listás, mind a fővárosi önkormányzati képviselői titulusáról.

Hajdu László elismerte tehát, hogy Hagyó Miklóssal szemben jogsértő állításokat tett. S bár a közölt nyilatkozatból kiderül, hogy a felek a maguk részéről az ügyet lezártnak tekintik, két dolgot szükséges megjegyezni. Részint azt, hogy Hajdu László különböző médiumokban megjelent nyilatkozatai kapcsán a volt főpolgármester-helyettes ellen feljelentést senki sem tett (Hajdu sem), ellene emiatt soha semmilyen eljárás nem indult (nyilván, mert a hatóságok megalapozott indokot erre nem találtak), részint és ezzel összefüggésben azt is, hogy az említett állítások nem csak sértőek voltak, hanem valótlanok is.

Many of the 15 defendants in the trial of the Budapest Transport Company (BKV) have claimed accused the interrogators of perhaps illegal interrogation tactics.  The promise of harsh pretrial jail time if the suspects did not provide the verbal evidence which the police sought has been one of the most common assertions from the group. 
Alongside these claims, many of the defendants have also declared that the prosecution first chose their culprits for the possibly unsubstantiated charges.  Then they attempted to produce the evidence.  In Hungarian a trial like this is a “koncepciós perek,” or a show trial. 
Well, it seems that two more dots have connected which might support the “koncepciós” theory. 
This connection lies in the relationship between György Pető and István Tarlós.  The latter is the current mayor of Budapest.  Pető was a former employee of the Budapest Police Department and allegedly involved with BKV’s investigation committee.  He was also one of deputy mayors of Budapest, alongside Tarlós, until 2007 when Miklós Hagyó’s city hall office manager defeated Pető for the MSZP representative slot of Óbuda.  Disgruntled over this, Pető left MSZP to become an independent.
Shortly after Pető went on to join the Budapest Police Department while Tarlós became the mayor of Budapest.

The trial of the Budapest Public Transport Company (BKV) continued on Tuesday, October 16th which included statements from Miklós Hagyó, the former socialist MP and deputy mayor of Budapest who was responsible for the oversight of BKV from 2006 until 2010. 
In response to last week’s testimony from Zsolt Balogh, the former Deputy Mayor said that neither his alibi nor the evidence he submitted during the investigation process were objectively considered by the appropriate authorities, during which he was subjected to a nine-month-long pretrial detention to prevent an alleged attempt to flee the country. Meanwhile, insisted Hagyó, the courts and the investigators readily accepted the verbal accusations of Balogh regardless of that fact that he had provided no substantial evidence for his incriminations. 
According to Hagyó, the indictment against him should be acquitted since it was solely based upon the wide-spread accusations throughout the media and verbal statements collected by the investigation authorities during interrogations with Balogh and Attila Antal.
 During the previous two weeks, both Balogh and Antal, who served as the CEO for the transportation company until a heart attack in early 2008 brought about his resignation, renounced their previous accusations against Hagyó.  According to the two men, both of whom are defendants in the case, they made the statements under duress from the interrogators who allegedly threatened them with more severe pretrial treatment.
Both Hagyó and Balogh, who served as the interim CEO for the ill-stricken Antal from February to August in 2008, have confirmed in their testimonies the extent of their relationship; neither the former Deputy Mayor nor any other person from the Budapest City Council ever wielded any power over the interim CEO.  Therefore, Hagyó claimed, Balogh was not pressured by him into overseeing the purportedly conspicuous contracts related to the development of the Budapest subway system. 
Hagyó considered it important to point out during Tuesday’s hearing that in Balogh’s written testimony he explained his role within the company when the alleged crimes occurred, “As the [Chief Technical Officer] I had a good perspective on the technological and engineering aspects, but I knew neither the economic and personal issues, nor the transportation and communication aspects.”  Many of the contracts in question were considered to be advisory in nature and not directly involved with Balogh’s departments.
Prior to his time as the interim CEO, Balogh had worked as the company’s CTO.  During that time, approximately between January 2007 and February 2008, the suspect contracts were created.  Among other things, Balogh accused Hagyó of using these contracts for personal or political profit, instead of developing the Budapest subway system.

So far I have introduced Hagyó Miklós, the former socialist politician (MSZP – Budapest district XII Deputy Mayor) and co-supervisor of the Budapest Public Transport Company (BKV), who for nearly three years has been the primary suspect in the high-profile BKV corruption scandal.

The MSZP didn’t care about the defense of the innocence either

Hagyó Miklós’s name was mired in the beginning of the BKV case – when they couldn’t even talk about reasonable suspicion. In the right party media (which was controlled and supported by politicians from the right party) there were news which stated that they have proofs about Hagyó’s malicious.  

The citizens who were only interested as a layman or they were just listening the news as an”ambient noise” could get very fob easily, we are not really surprised on this. But we surprised that for the MSZP – where Hagyó was hustling/working from 1998, at the age of 31 – this was enough to ask him to stand off/resign in the beginning of February, 2010. The defense of the innocence and the personal knowledge during the common works weren’t even enough in the light of published media.

As the then articles said: „According to the press information, Antal Attila made an incriminating statement against Hagyó Miklós, the former CEO of BKV who were suspected with a misappropriation, and Balog Zsolt the former temporary leader of the company.”
„The MSZP got the information/learned from the media, that the former CEO of the BKV made a statement against the former lord mayor (she wrote here lord mayor, but he was deputy lord mayor…). The not-traversed leak means that Hagyó Miklós will be a defendant. Here the role of the politics are ended, the legal process will take years – said the metropolitan vice-president of the MSZP.”

With a solid vote they decided that they don’t want to incriminate/charge the MSZP with a case like this, so they asked him to resign from the nomination of the individual representative, and to resign about his „list place in Budapest” and his mandate in the capital general assembly.

Then, from an interview in Népszava: „until the end of the week the MSZP wants to close this case. According to our information the party will wait for his answer until Wednesday, if the answer will be no, or he not deciding they will start the former process, with that, they will take off his name from both list. At the same time they can’t deposal him from his mandate in the capital general assembly, about that only the representative can decide.”

The MSZP justified their decision of their presidency (with what the then president of the party and the national leadership agreed): „although they believe in the innocence of their party partner, but because of the political status which evolved around him they asked him to resign, because the interest of the party is more advanced then the personal interests.”

For the question, if they believe in the innocence of Hagyó, then why should he resign about the representative nomination, and about the representative of the capital, the MSZP’s president of the capital answered: because of the weight of the statements. 

The party even in the beginning of the case made a distance from Hagyó, then years later, on the 25th of March, 2012, Szanyi Tibor, the socialist representative of the parliament said in his interview to the MTI in the reference of/about Hagyó Miklós: „with what they suspect him, he is absolutely innocent, he never seen the Nokia box, not even a small one, not even a big one.”
