The BKV case is starting tomorrow – Népszava article


Tomorrow the BKV case is continuing with an interesting count in the Kecskemét Tribunal. The next count’s weirdness, which is connected to the BKV’s passenger informant system, that Balogh Zsolt, the former CEO of the BKV, in his testimony against Miklós Hagyó (who is the deputy lord mayor),he admitted an accounting sheet as his own when in reality he didn’t even signed it.



According to the indictment the contract with the C.C. Soft Ltd, which was about the configuration of the Local Train of Szentendre’s visual passenger informant system, made 118,8 million forints of financial disadvantage for the transportation company. In the company’s inside enquiry report in February, 2010, and in the accusation it says that the partial invoices, the efficiency certifications, and the accounting sheets which were connected to the contract was signed by Balogh. Moreover, Balogh also stated this in his testimony in March, 2010. 

However the technicality of the inside control and the work of the investigation workers are queried that Balogh admitted an accounting sheet from December, 2007, but in reality the former CEO didn’t even sign it. Hagyó was the one who draw attention to the really interesting process of proof, who was only accused in this case because of Balogh’s testimony. According to his opinion, the fact that Balogh admitted his signature in the accounting sheet it is such a momentum of the process which proves the defendant 4th real motivation of his testimony. Balogh in his court testimony he stated that he was only framed incriminating testimony against others – among about the former deputy lord mayor – to suit for the expectations and to avoid jail.

Similarly to Balogh in the earlier period of the trial a lot of main defendant and witnesses recalled their testimonies and they made a new one in court. For their incriminatory testimonies in the police station they said that they only did it under threat, in humiliating environment, it was directional and they only did it because of coercion. According to their telling the investigators asked for incriminatory testimonies against Miklós Hagyó and his environment for exchange of their freedom, but there was a defendant from whom they wanted to get incriminatory testimony against Ferenc Gyurcsány, who is the former prime minister. Anyway, the case’s most important count is the Nokia-box accusation which is based on Balog’s testimony. Balogh also recalled his testimony about this. According to the defenders who are in the case the testimony would have been insupportable anyway because Balogh often edited it in matter of fact, moreover, he communicated absolutely something else to the media and to the authorities.

Holnap folytatódik a BKV-per

Érdekes vádponttal folytatódik holnap a BKV-per tárgyalása a Kecskeméti Törvényszéken. A soron következő, a BKV utastájékoztató rendszerét érintő vádpont egyik furcsasága, hogy nyomozati vallomásában a Hagyó Miklós főpolgármester-helyettesre terhelő állításokat tett Balogh Zsolt vádlott - a BKV volt vezérigazgatója - egy olyan számfejtési ívet is elismert sajátjának, amit valójában nem is ő írt alá.

A vádirat szerint a szentendrei HÉV vizuális utastájékoztató rendszerének kiépítésével kapcsolatos, a C.C.Soft Kft.-vel aláírt szerződés megkötése 118,8 millió forint vagyoni hátrányt okozott a közlekedési cégnek. A vállalat 2010 februári belső vizsgálati jelentésében és a feljelentésben is az szerepel, hogy a szerződéshez tartozó rész-számlákat, teljesítési igazolásokat és számfejtési íveket Balogh írta alá. Sőt, Balogh is ezt állította 2010 márciusi nyomozati vallomásában.

A belső ellenőrzési vizsgálat szakszerűségét, és a nyomozó hatóságok munkáját azonban megkérdőjelezi, hogy a korábban Balogh által magáénak elismert 2007 decemberi számfejtési ívet valójában nem is a volt cégvezető írta alá. Az igen érdekes bizonyítási eljárást ígérő ellentmondásra Hagyó hívta fel a bíróság figyelmét, akit kizárólag Balogh nyomozati vallomása alapján vádoltak meg ebben az ügyben. Véleménye szerint az, hogy Balogh a számfejtési ív aláírását is sajátjaként ismerte el, olyan mozzanata az eljárásnak, amely igazolja a negyedrendű vádlott nyomozati vallomásának tényleges motivációját. Balogh a bírósági vallomásában már azt állította, azért fogalmazott meg a választási kampány alatt terhelő állításokat - többek közt a volt főpolgármester-helyettesről -, hogy megfeleljen az elvárásoknak, illetve elkerülje a börtönt.

Balogh-hoz hasonlóan a tárgyalás korábbi szakaszában a fő vádlottak és tanúk közül többen is visszavonták nyomozati vallomásukat, és a bíróságon új vallomást tettek. A rendőrségen tett, másokra nézve terhelő vallomásaikról elmondták, azokat fenyegetés hatására, megalázó körülmények között, irányítottan, "kényszervallatás" hatására tették. Elmondásuk szerint a nyomozók az elsőrendű vádlott Hagyó Miklósra és környezetére kértek terhelő vallomásokat a szabadságukért cserébe, de volt olyan vádlott is, akit arra próbáltak rábírni, hogy Gyurcsány Ferenc volt kormányfőre valljon. Balogh nyomozati vallomására épül amúgy az ügy leglátványosabb vádpontja, a Nokia-dobozos vádpont is. Balogh erről szintén visszavonta vallomását. Az ügyben eljáró védők véleménye szerint ez a vallomás egyébként is tarthatatlan lett volna, azt ugyanis Balogh ténykérdésekben sűrűn módosította, sőt, a sajtó és a hatóságok felé is egészen mást kommunikált.
