BKV case: absurd mix-up in the court room – Stop.hu article



On the Kecskemét Tribunal they would prove the condition of the local train’s passenger informant system in 2008 with photos which were taken in 2011. From this it became a comical mix-up, but they still couldn’t prove the accusation.





On the Thursday’s hearing on the carpet it was again the accusations of the contracts with the C. C. Soft. The witnesses who were heard were the responsible people in the department of the investment of the local train’s passenger informant system. One of them, F. P. as he said, he feels that in the October of 2007 at the explosion of the media scandal he became in the position like this because he was inexperienced and manageable. He stated that for November, 2007 the testing could start and however a lot of mistakes were revealed, the workers of the C. C. Soft did everything for the insurance of the system’s working. The witness stated in his investigation testimony that Zsolt Balogh, that time deputy CEO of the BKV, took in the decision power. With this he would have support the concept of the accusation but for the questions of the defense he said that from the defendants, no one ordered him to any outlawry or committal of an abuse. Attila Antal, the former CEO of the BKV, in his observation he noted that if F. P. wouldn’t have signed the achievement certification which are in the accusation then they couldn’t paid the C. C. Soft, and then the project would have been stopped which the witness was responsible for. 


The other witness of the day, G. K., the ancestor of F. P., was mostly questioned in the connection of the calling for tender. G. K. denied that during the tender the case maps were standardized to the Autocom Ltd. which was the rival of the C. C. Soft Ltd. For the ask of a lawyer he said that he said his observations with the winner of the tender and about his work in verbal after he participated in the collection of the technological and offer propositions as an electrical engineer.

The comedy scenes which were mentioned in the intro, it came when they showed photos to the court which proved the work of the C. S. soft Ltd. F. P. said that he was the one who collected the documents for the inside audit of the BKV, he attached photos to it but he didn’t identify the pictures what they showed him. It took time but it turned out that it can be possible, because these photos weren’t those: the photos which were showed in the court was took in April 27, 2011, two and a half year after the dead-line of the guarantee of the C. C. Soft Ltd. Attila Antal had an affixture too: the former CEO mentioned that in September of this year he took photos too on the stations of the local train. Based on those the devices are still in a good condition and that the BKV, with a little care, could run the system on a 100%, which in the end of 2008 had an available index of a 96.9%.

2011-ben készült fényképekkel bizonyították volna a HÉV utastájékoztató rendszerének 2008-as állapotát a Kecskeméti Törvényszéken. Ebből komikus kavarodás lett, de a vádat bizonyítani továbbra sem sikerült.




A csütörtöki tárgyalási napon ismét a C.C. Soft Kft. szerződései kerültek terítékre. A meghallgatott tanúk a BKV beruházási főosztályán a HÉV utastájékoztató-projekt felelősei voltak. Egyikük, P.F., mint mondta, úgy érzi, hogy 2007 októberében, a sajtóbotrány kirobbanásakor azért került ebbe a szerepkörbe, mert tapasztalatlan és irányítható volt. Kijelentette, hogy 2007 novemberére megkezdődhetett a tesztüzem, és bár több hibára is fény derült, a C.C. Soft szakemberei mindent megtettek a rendszer működésének biztosítására. A tanú nyomozati vallomásában azt állította, hogy Balogh Zsolt, az akkori műszaki vezérigazgató-helyettes magához vonta a döntési jogköröket. Ezzel a vád koncepcióját támasztotta volna alá, de a védelem kérdéseire most elmondta, hogy a vádlottak közül őt senki nem utasította törvénytelenségre, illetve szabálytalanságok elkövetésére. Az ügy harmadrendű vádlottja, Antal Attila egykori BKV-vezérigazgató észrevételében megjegyezte, hogy amennyiben P.F. nem írta volna alá a vádban szereplő teljesítés-igazolásokat, akkor a C.C. Soft-ot nem fizethették volna ki, és a projekt, aminek a tanú a fő felelőse volt, leállt volna.


Az nap másik tanúja K.G., P.F. elődje volt, akit főképp a pályázati kiírással kapcsolatban kérdeztek. K.G. tagadta, hogy a pályáztatás során a C.C. Soft Kft. versenytársára, az Autocom Kft.-re szabták volna a feltételrendszert. Ügyvédi kérdésre közölte, a pályázat nyertesével, és annak munkájával kapcsolatos észrevételeket szóban tette meg, miután villamosmérnökként a műszaki és ajánlattételi dokumentáció összeállításában vett részt.

A bevezetőben említett vígjátéki jelenetekre akkor került sor, amikor a C.C. Soft által elvégzett munkát bizonyító fotókat mutatták be a bíróságnak. P.F. ugyanis elmondta, hogy a BKV-s belső vizsgálat dokumentumait ő állította össze, fényképeket is csatolt, de a most bemutatott képi anyagra nem ismert rá. Időbe telt, de kiderült, hogy ez azért lehetséges, mert a fényképek nem azok voltak: a bíróságon bemutatott képanyagot 2011. április 27-én készítették, két és fél évvel a C.C. Soft Kft. garanciavállalásainak határideje után. Antal Attilának ehhez is volt hozzáfűznivalója: az egykori vezérigazgató megjegyezte, hogy idén szeptemberben ő is készített képeket a HÉV-állomásokon. Ezek alapján a berendezések még mindig jó állapotban vannak, a BKV kis odafigyeléssel száz százalékosan tudná működtetni a rendszert, ami 2008 végén 96.9 százalékos rendelkezésre állási mutatóval rendelkezett.
