Hagyó, ex socialist Deputy Lord Mayor, was sentenced to tow-year imprisonment suspended for four years for abuse of authority and breach of fiduciary duty as inciter by the Court of Kecskemét at first instance on Tuesday. The charge of bribery, however, was dropped.

The charge against Ernő Mesterházy (ex political chief advisor of the Lord Mayor), second accused, was dropped by the judicature presiding by Ibolya Hadnagy. According to the explanation of their decision in his case only one act of incitement without result could be established.

If it is up to the prosecutor, Hagyó will be never released

According to the prosecution authority in case of eight accused the charge of continuous breach of fiduciary duty through organized crime is factual therefore the prosecutor requested for their heavy prison sentence and the exclusion of their release on parole in his prosecutor speech.

In case of Miklós Hagyó, Attila Antal, Zsolt Balogh and Miklós Regőczi the fact that the sentence for engagement in organized crime was raised from 20 to 25 years has not only theoretical significance – said Prosecutor János Homonnai representing the Prosecution - when at the end of his prosecutor speech he itemized the charges against each accused and the sentences he is requesting for them after closing the prosecution’s case-in-chief at first instance. According to his opinion in case of Miklós Hagyó, Ernő Mesterházy, Attila Antal, Zsolt Balogh, Miklós R., Ottó L., Éva M.-H. and Miklós H dr. the charge of engagement in organized crime – threatening the accused with double sentence – and the act of causing continuous and extraordinary material loss are well-based.

Most of the accused are charged with aggravated breach of fiduciary duty – some of them are charged as offenders, some of them are charged as instigators and others as abettors. Besides, Miklós Hagyó is charged with two counts of abuse of authority and two counts of bribery committed as an executive official. Besides breach of fiduciary duty, Attila Antal, Zsolt Balogh and Miklós R. are charged with more counts of falsification of private documents, as well. The rest of the accused are also charged with breach of fiduciary duty and falsification of private documents without the fact of engagement in organized crime.

When did BRFK start the investigation?

Although there were no condemning investigations at BKV before 2008, BRFK entered the campaign in 2010. One day after Hagyó resigned from BKV’s supervisory board Gábor Tóth police chief informed the transporting company about continuing criminal procedure. Police initiated the arrest of Szalainé 90 days prior to the elections and kept on accusing BKV persons. The investigation landed in the hands of Hagyó’s former political rival: György Pető used his position to recruit managers of some companies owned by the capital before the municipality elections, who were supposed to be informants to the police.

There were really no condemning internal investigations at BKV?

Really there were not. Two internal investigations stated in 2008 that all the contracts of the affected period are ok. Supervisory Board accepted the investigation of the Internal Supervisory Department on October 16, 2008 with respect to that those reports contained the entire advisory circle and there were no ascertainments that would have requested further steps to take. The general meeting of 2008 accepted Zsolt Tiba’s report (capital clerk) with the attachments which were reports on the contracts between BKV and AAM Zrt.

A Difficult Path

The hearing on March 19th, 2013 of the trial of the 15 associates of the Budapest Transit Company (BKV) bore no significant fruit for the defendants.






The most entertaining event in the hearing was the discovery of a connection between a defendant and a witness. The relationship was detected on a social media site. However, the importance was thereafter deemed “pointless” because the concerned parties admitted the existence of a professional relationship.

December 13th, 2012 Hearing: the 13th Defendant Supports BKV’s Strategy to Cut Loses

On Thursday, December 13^th, 2012 the trial of the Budapest Public Transport Company (BKV) saw the year’s final hearing in Kecskemét, Hungary.

The subject of the hearing was another allegedly conspicuous contract between DAM Lp. and BKV which was created on October 1^st, 2007.  Apparently, BKV was trying to come up with a solution which would stop people from using the public transportation system without paying for tickets.  As such, they employed DAM to conduct a study about youngsters’ attitudes toward corporate communication.  The contract between DAM and BKV was determined to be 250,000 forints per month before taxes (just more than $1,100.00 at time of writing [ATW]).  The contract was canceled on June 15, 2009.

DAM representative and the 13th defendant in the BKV trial, Dr. Zsuzsanna Mecsér Kovács claimed in court on the 13^th that the contract between her company and BKV was necessary.

Mecsér is accused of acting as an accomplice in a criminal organization by aiding in the misappropriation of public funds.  According to the indictment, she caused BKV damages totaling 5,700,000 forints (almost $26,000.00 ATW).

Mecsér claims that DAM’s work for BKV was effective and transparent while the prosecution, however, asserted that the work’s paper trail is incomplete and lacking transparency.  Luckily for the defendant, though, the judge claimed to find no basis for the prosecutions assertions.

In reaction to Mecsér’s testimony, Attila Antal, who was the former CEO of BKV, claimed that because of certain strategies such as the contract with DAM the public transport company cut their losses by 11 billion forint under his leadership (nearly $50,000,000.00 ATW).

Following Antal’s lead, the former deputy CEO Miklós Regőczi cited a document which claims that BKV still employs strategies such as the DAM contract to ensure customers pay for tickets.  Regőczi also noted that today, however, these strategies are not tried as a crime.

Lelovics Ottó made a proposal for the summon of Vitézy Dávid, the CEO of the BKK (Centre for Budapest Transport) on the hearing of the BKV case, who is the former press person of the main defendant in the case, Hagyó Miklós. On the today hearing, one of the defendant cried, and another thinks that the prosecution was working on the campaign of the Fidesz. The former deputy lord mayor, Hagyó compared the prosecutors to the palmists.

The Hagyó case continued on Tuesday on the Kecskemét Court with the hearing of the former communication leader’s testimony. The accused Vitéz Ágnes denied his guiltiness with the signing of unneeded contracts and with the verifications of achievements. She maintained her investigation testimonies and she denied in details the statements of the indictment – according to her opinion those are unprofessional. She stopped his testimony 10 minutes after the start, she cried so they ordered a break. After the break with the fight of her tears she said that she feels the whole process derogatory, she is unable to tell her testimony, so in the end Hadnagy Ibolya judge read out loud her testimony.

Vitéz Ágnes in her testimony she said that she is proud of her work while she was working at the BKV. She showed her job as a communication’s leader and international relationship in details. She said, she had no right to sign contracts alone, in more contracts which is the basis of the indictment she signed it on the second place and she said it’s weird that the people who signed it on the first place are not the part of the process. At the same time she said that it’s okay, because nor she, either any others didn’t commit a crime.

In her testimony Vitéz tried to prove that the prosecution chose the defendants by political concept. She said that the BKV makes calendars every year for their workers, but it was only a crime in 2009. She was incomprehension with the fact that how can a website be unneeded which was chosen for the best website of the year, and how could the Combino (the Combino are the tramp 4 and 6 which is going on the boulevard of Budapest) commercial be unneeded what won first place in a titled international competition, and it made a good news for Hungary and for the BKV.

„The marketing wasn’t just needed but it was mandatory” – Vitéz referred to the expectations for the owner, and then she showed the souvenirs which were made in the time she was working there and these souvenirs are still reordered. She said that a lot of time she turned back bills if she thought the amount is too high, and she supervised/checked every achievements what she verified. She always tried to have the best service on the best price from the subcontractors of the BKV.

On the observation of the testimony Hagyó Miklós said that there are proof from professionals and their testimonies which are confront with the indictment’s unprofessional „palmistry”. And Lelovics Ottó made a proposal for the summon of Vitézy Dávid who is the leader of BKK, and he reminded that the BKK last week feast his workers from public money. Regőczi Miklós, the former deputy CEO of BKV said that it’s sad that the investigators parted in the campaign of the Fidesz, because in the big campaign of 2010 they incriminated a lot of leader of the BKV then „they didn’t even spoke to them for a year”.

Vitézy Dávid, a Budapesti Közlekedési Központ (BKK) Zrt. vezérigazgatójának idézésére tett indítványt a BKV-per tárgyalásán Lelovics Ottó, a büntetőeljárás fő vádlottjának, Hagyó Miklósnak a korábbi sajtósa. A mai tárgyaláson egy vádlott elsírta magát, egy másik szerint pedig az ügyészség a Fidesz kampányán dolgozott. A volt főpolgármester-helyettes Hagyó ezúttal tenyérjósokhoz hasonlította az ügyészeket.

A BKV egykori kommunikációs osztályvezetőjének vallomástételével folytatódott a Hagyó-per tárgyalása kedden a Kecskeméti Törvényszéken. A szükségtelennek vélt szerződések megkötésével és valótlan teljesítések igazolásával vádolt Vitéz Ágnes minden vádpontban tagadta bűnösségét, fenntartotta nyomozati vallomásait, és részletesen cáfolta a vádirat - véleménye szerint szakmaiatlan - állításait. Vallomástételét tíz perccel a kezdés után megszakította, sírva fakadt, így szünetet rendeltek el. A szünet után könnyeivel küszködve elmondta, méltatlannak érzi az egész eljárást, vallomását képtelen elmondani, így azt végül Hadnagy Ibolya bírónő olvasta fel.

Vitéz Ágnes vallomásában úgy fogalmazott, büszke az általa a BKV-nál végzett munkára. Kommunikációs vezetőként és a nemzetközi kapcsolatok terén végzett munkáját hosszan mutatta be. Elmondta, neki nem volt joga egyedül szerződéseket kötni, több, a vád tárgyát képező kontraktus esetében csak második helyen írt alá, és furcsállja, hogy az első helyen aláíró személyeket nem vonták eljárás alá. Ugyanakkor megjegyezte, ez így is van rendjén, mert sem ő, sem mások nem követtek el bűncselekményt.

Vallomásában Vitéz azt kívánta igazolni, hogy az ügyészség politikai koncepció alapján válogatta ki a vádlottakat. Elmondta, hogy a BKV minden évben készít naptárakat a dolgozóinak, ám az csak 2009-ben számított bűncselekménynek. Értetlenkedett amiatt is, miként lehet szükségtelen egy olyan honlap elkészítése, amelyet az év honlapjának választottak, és miként lehetett szükségtelen a Combino-reklámfilm, amely neves nemzetközi versenyen nyert első helyezést, jó hírét vívén a világba Magyarországnak és a BKV-nak.

"A marketing nem csak szükséges volt, de kötelező" - utalt Vitéz a tulajdonosi elvárásokra, majd bemutatta az ő idejében készült, azóta is utánrendelt BKV-s ajándéktárgyakat. Beszélt arról is, hogy sok esetben visszaküldött számlákat, ha azok összegét magasnak ítélte, és minden teljesítést ellenőrzött, amit leigazolt. Mindig arra törekedett, hogy a legjobb áron, a legjobb szolgáltatást kapja alvállalkozóitól a BKV.

A vallomásra tett észrevételében Hagyó Miklós elmondta, nemzetközileg elismert szakemberek bizonyítékokkal alátámasztott vallomásai állnak szemben a vádirat szakmaiatlan "tenyérjóslásával". Lelovics Ottó pedig indítványt tett Vitézy Dávid BKK-vezér megidézésére, emlékeztetve, hogy a BKK a múlt héten közpénzből vendégelte meg dolgozóit. Regőczi Miklós, egykori BKV-s vezérigazgató-helyettes szomorúnak nevezte, hogy a hatóságok részt vettek a Fidesz kampányában, hiszen 2010-es kampányhajrában több BKV-vezetőt meggyanúsítottak, majd "egy évig hozzájuk sem szóltak".

His name mentioned in the renounced testimony untruly – Somogyi Zoltán felt like this, who is one of the former owners of the company which had been related to one of the BKV’s contract. He realized on the day of the hearing of Regőczi Miklós, that the VIII. defendant’s investigation testimony states untrue statements about him. Somogyi wasn’t questioned by any investigation authorities from the beginning of the case, so he denied the statements about himself on his Facebook page.

Regőczi – according to his statements – in the investigation part of the Hagyó case, he said that he was only saying that he had to sign the contract with the GPS Capital (Somogyi’s communication company) because of the order from Antal Attila, but he said that under psychical pressure and impulse. Somogyi recommended to him in the meeting that they should sign contract for 1 million forints per month, for configure useful relationships. According to the earlier testimony, Lendvai Ildikó from the MSZP wanted to place one of her friend at the BKV who would have been unsuited for the task, so in the end Regőczi asked Somogyi to place that person in his company (in the GPS Capital), and they will pay as much contractor fees for the lobby activities. Instead of the 1 million per month they agreed in 1,8 million per month what included the salary of Lendvai’s friend.

So Somogyi is a key man in the BKV case, whose name was already mentioned in the investigation session. However the investigation is going on since 2 years – in a case where they questioned more that a 100 witnesses, he was never questioned by any authorities as a defendant or as a witness. He is not the first „phantom” of the process. The investigators didn’t question the so called mediator/middleman of the Nokia-box story, or the person who wanted to bribe Balogh Zsolt.

On the day on Regőczi’s testimony at court, Somogyi Zoltán responded on his own Facebook page for the parts of the testimony what was about him. He said as a fact, that he never worked with Regőczi in a campaign of SZDSZ politicians, and in any other campaign. He was a part-owner in a company, what had a part-own in a today acclaimed company too and it was working with configure useful relationship. This company signed a contract with the BKV in 2007 for taking pictures in opportunities of union tender. He never led this company and the company was made the job square. According to Somogyi this company – opposite of the testimony – never varied contract with the BKV, and it never employed anyone for „political order” as a co-worker: „Who knows me, know that it doesn’t pay to turn to me with questions like this.” Somogyi in his writing verified that with the contracts no investigation authority investigated at the company, or at him (nor police, nor prosecution, nor any other organ).  He ended his respond with a huge indignation: „I think it is rubbish and unmanly to mire people, so as well when they are trying to do it with me.”

Igaztalanul hangzott el neve egy visszavont vallomásban - véli Somogyi Zoltán, egy BKV-s szerződéssel összefüggésbe hozott cég volt résztulajdonosa. Regőczi Miklós bírósági kihallgatásának napján tudta meg, hogy rá nézve valótlan állításokat tartalmaz a nyolcadrendű vádlott nyomozati vallomása. Somogyit az ügy kezdete óta nem hallgatta meg semmilyen nyomozóhatóság, így saját Facebook-oldalán cáfolta a róla szóló állításokat.

Regőczi – állítása szerint – a Hagyó-ügy nyomozati szakában pszichikai nyomás és sugallat hatására vallotta, hogy Antal Attila utasítotására meg kellett egyeznie a GPS Capitallal, Somogyi kommunikációs cégével. Somogyi javasolta neki a találkozón, hogy havi 1 millió forintra kössenek szerződést, lobbitevékenységre. A korábbi vallomás szerint továbbá az MSZP-s Lendvai Ildikó el akarta helyeztetni a BKV-nál egy, a feladatra alkalmatlan ismerősét, akit végül Regőczi Somogyival alkalmaztatott a GPS Capital-nál, és inkább annyival több vállalkozói díjat fizettek neki a lobbizásért. A havi 1 millió helyett havi 1,8 millióban egyeztek meg, amiben benne volt a Lendvai protezsáltjának fizetendő pénz is.

Somogyi tehát egy olyan kulcsfigurája a BKV-ügynek, akinek neve már a nyomozati szakaszban felmerült. Azonban a nyomozás két és fél éve alatt - egy olyan ügyben, ahol száznál több tanút hallgattak ki, őt soha, semmilyen nyomozóhatóság nem hallgatta meg se vádlottként, se tanúként. Nem ő az első "fantomja" az eljárásnak. Szintén nem hallgatták meg a nyomozók az állítólagos Nokia doboz közvetítőjét, vagy a Balogh Zsoltot megvesztegetni akaró személyt.

Regőczi bírósági vallomástételének napján Somogyi Zoltán saját Facebook-oldalán reagált a korábbi vallomás őt is érintő részeire. Tényként közölte, hogy soha nem dolgozott együtt Regőczivel SZDSZ-politikusok kampányában, és semmilyen más kampányban sem. Ő résztulajdonosa volt egy cégnek, amelynek résztulajdona volt egy lobbival foglalkozó, ma is elismert cégben, amely a BKV-val szerződött 2007-ben, uniós pályázati lehetőségek feltérképezésére. Ezt a céget ő sohasem irányította, a cég a munkát tisztességesen elvégezte. Somogyi szerint ez a cég – a tanúvallomás állításával szemben – soha nem módosított szerződést a BKV-val, és senkit nem alkalmazott "politikai megrendelésre" munkatársként: "Aki ismer, az tudja, hogy ilyen kérésekkel nem érdemes hozzám fordulni." Somogyi írásában azt is megerősítette, hogy a szerződéssel kapcsolatban semmilyen nyomozóhatóság (sem rendőrség, sem ügyészség, sem más szerv) nem vizsgálódott sem a cégnél, sem nála. Reagálását mély felháborodással zárta: "Szemét és férfiatlan dolognak tartom emberek meghurcolását, így azt is, amikor ezt velem próbálják megtenni."

On the Kecskemét Court the criminal procedure continued with the case of Hagyó Miklós and his fellows. The main character was again the I. accused, Hagyó who is charged as the leader of a criminal organization with misappropriation, bribery/corrupt practices, malfeasance and with blackmailing. Hagyó made observations about the testimony of the VIII. Accused, Regőczi Miklós.

In this „old song has been score again”, so with the attack for the prosecution, Demszky Gábor came up too, who already was in Regőczi’s investigation testimony. Hagyó recalled that because of the order of the former lord mayor, they had to make the deputy CEO of the BKV the neighbor of Demszky. Demszky ordered the leader of the BKV to order a treatise for the making of the parameter book from a particular company, and he gave order to advertise in the PestiEst, and to sign a contract with his neighbor’s (Olti Ferenc’s) company, who thought his salary as a deputy CEO of BKV is exiguous.

Hagyó Miklós – on the basis of Regőczi Miklós’s investigation testimony – recalled that Tóthfalusi György delegate/representative of SZDSZ, Olti Ferenc „neighbor” and Dancs Gábor the aldermen of transportation, they all gave orders for signing contracts, however it’s „qualify the own approach” of the prosecution, that they not just didn’t become defendants in this case, but they even didn’t become witnesses.

„What’s the importance of this?– assume the question Hagyó. – Against who and why they start a procedure? Against who and why they end that? Who is that who wasn’t even heard as a witness?” He added: „Though I’m persuaded that my politician colleagues proceeded legally, however their names came up in the records as persons who gave orders for the leaders of the BKV, even so there was no investigation against them.” And for the train of thought becomes a whole, the I. accused hopes, that for the end of the process the court will get the answer too for the real background of the choosing.

Hagyó – continued the facts for the exposure of the prosecution – recalled that the deputy CEO of communications of the BKV said about one of the contracts what the prosecutions says in the indictment that it was unneeded, he is talking in his questioning on the 10th of February, 2010 as „it was needed”, but on the 26th of February he said about the same thing that „it wasn’t needed, the buses are fine without it”. Namely it was a GPS contract.

The former deputy lord mayor explained his changing of his testimony that Regőczi Miklós in the time of the first questioning was only in house arrest, but at the second time he was in pre-trial detention, so he corroborated the leader of the BKV’s court testimony, according to that he confessed under the pressure of psychic duress, and he said what the investigators „wanted to hear”.

„Either me or my colleagues had no right for ordering in the administration” – repeated Hagyó Miklós this sentence for like the 100th, or maybe the 1000th time during his questioning, moreover he added about the members of the administration who are sitting at the dock that „they proceeded religiously, profoundly and they kept the rules”, simply „their love for the work” drove them, and during the investigation they only stated things which had no basis of truth because of the „thirst for the convenience” for the prosecution.

About the 300 million forints contract with the Synergon – Hagyó is charged by this for the receiving of the 2x15 million forint of slush-fund – the I. accused said that it was the will of the capital to sign with this company, but he doesn’t know exactly who made this decision at the capital.

The BKV, as the affronted of the criminal procedure, yesterday announced that they are going to report a civil law claim for the 1,5 billion forints which is said in the indictment, and moreover for the affix of the caused damages, and because of this they asked the court that in every accused the court should keep up the property lock what the Court of Budapest already ordered.

The V. accused and the XIX. accused, Lelovics Ottó and Szilágyiné Szalai Eleonóra motioned for the release of their property lock, but their proposal was rejected yesterday.

A Kecskeméti Törvényszéken tegnap folytatódott a büntetőeljárás Hagyó Miklós és társai ügyében. A főszereplő ismét az elsőrendű vádlott, a bűnszervezet vezetőjeként hűtlen kezeléssel, vesztegetéssel, hivatali visszaéléssel és zsarolással vádolt Hagyó volt, aki a nyolcadrendű vádlott, Regőczi Miklós, egykori BKV-vezérhelyettes vallomásához fűzött észrevételeket.

Ebben a régi dalt újra hangszerelve, vagyis az ügyészséget támadva terítékre került Demszky Gábor, aki felbukkant Regőczi nyomozati vallomásában is. Hagyó felidézte, a volt főpolgármester utasítására kellett felvenni a BKV-hoz vezérigazgató-helyettesnek Demszky szomszédját. Demszky utasította a BKV vezetőit, hogy egy bizonyos cégtől rendeljenek tanulmányt a paraméterkönyv elkészítéséhez, és ő adott utasítást arra is, hogy hirdessenek a Pesti Estben, s hogy kössenek szerződést szomszédja, Olti Ferenc cégével, aki kevesellte BKV-vezérigazgató-helyettesi fizetését.

Hagyó Miklós – Regőczi Miklós nyomozati vallomása alapján – felidézte, hogy Tóthfalusi György SZDSZ-es képviselő, Olti Ferenc „szomszéd” és Dancs Gábor közlekedési tanácsnok is adott utasítást szerződések megkötésére, ám az ügyészség „sajátos szemléletét minősíti”, hogy ők nemhogy vádlottak nem lettek az eljárásban, de még tanúk sem.

„Mi a jelentősége ennek? – tette fel a kérdést Hagyó. – Kivel szemben és miért indít eljárást? Kivel szemben és miért szünteti meg azt? Ki az, akit még tanúként sem hallgat meg?” Hozzátette: „Noha meg vagyok győződve arról, hogy politikustársaim jogszerűen jártak el, ám nevük mégis felbukkan a jegyzőkönyvekben, mint olyan személyeké, akik utasítást adtak a BKV vezetőinek, ennek ellenére velük szemben nem folyt nyomozás.” S hogy a gondolatmenet befejezése gömbölyű legyen, az elsőrendű vádlott annak a reményének adott hangot, hogy az eljárás végére a törvényszék is választ kap a kiválasztás okainak igazi hátterére.

Hagyó – folytatva az ügyészség „leleplezésének” tényeit – felidézte, hogy a BKV kommunikációs vezérigazgató-helyettese az egyik, az ügyészség által a vádiratban szükségtelennek tartott szerződésről 2010. február 10-i kihallgatásán még úgy beszél, hogy ez „hasznos volt”, de február 26-án már azt mondta ugyanerről, hogy „semmi szükség nem volt rá, enélkül is mennek a buszok”. Tudniillik egy GPS-szerződésről volt szó.

Az egykori főpolgármester-helyettes a vallomás módosítását azzal indokolta, hogy Regőczi Miklós az első vallomás idején még csak házi őrizetben volt, ám a másodiknál már előzetes letartóztatásban, kvázi ezzel is alátámasztva a BKV-vezető bíróság előtt tett vallomását, amely szerint pszichikai kényszer hatására vallott, s azt mondta, amit a nyomozók „hallani akartak”.

„Sem nekem, sem munkatársaimnak a kabinetben nem volt utasítási jogköre” – ismételte meg Hagyó Miklós a kihallgatása során százszor, tán ezerszer is elhangzott mondatot, sőt a kabinetjének a vádlottak padján ülő tagjairól azt is hozzátette, valamennyien „lelkiismeretesen, alaposan, a szabályokat betartva jártak el”, csupán a „munkaszeretetük” vezette őket, s a nyomozás során legfeljebb az ügyészségnek történő „megfelelni vágyás” miatt állítottak olyanokat, amelyeknek nem volt valóságalapja.

A 300 milliós Synergon-szerződés­ről – ennek kapcsán vádolják Hagyót kétszer 15 millió forint kenőpénz átvételével – az elsőrendű vádlott azt mondta, a főváros akarata volt, hogy ezzel a céggel szerződjenek, bár azt konkrétan nem tudja, a döntést ki hozta meg a fővárosnál.

A BKV, mint a büntetőügy sértettje, tegnap bejelentette, hogy a vádiratban szereplő másfél milliárd forint, illetve az okozott kár járulékainak erejéig polgári jogi igényt jelent be, s emiatt kérte a törvényszéket, hogy valamennyi vádlott esetében tartsa fenn a Fővárosi Törvényszéken korábban elrendelt vagyoni zárakat.

Az ötödrendű és a tizennegyed­rendű vádlott, Lelovics Ottó és Szilágyiné Szalai Eleonóra indítványt tett vagyontárgyaik zár alóli feloldására, ám indítványaikat tegnap elutasították.

November 15th Hearing: Regőczi’s Testimony is Still Hotly Discussed

During the hearing of the Budapest Public Transport Company (BKV) on Thursday, November 15^th, 2012 in Kecscemét, Hungary the public transportation company reviewed their civil law claims.  The representative from BKV, after reading their accumulated financial damages according to the formal indictment, announced that the 15 defendants will be responsible for the nearly 1.8 billion forint reimbursement (just less than 8.2 million USD at the time of writing [ATW]).  

Miklós Hagyó, the primary defendant who as deputy mayor of Budapest between 2006 and 2010 maintained political oversight of the public company, has been charged with damages totaling 168 million forint (almost $765,000.00 ATW).  Hagyó, who is facing charges of misappropriation of public funds, bribery, and managing a criminal organization, continued to rebut the accusations against him, especially those from the interrogation of the fifth defendant, Miklós Regőczi.

Hagyó asserted that according to the evidence accrued and the progression of the trial he is not certain where the basis of the indictment against him and other defendants is founded.  Hagyó also noted the amount of potential witnesses who have not been called to testify in the case.

Miklós Regőczi held various high level positions in the communications and sales departments of BKV from 2007 onward.  During 2010 interrogations, Regőczi verbally incriminated other defendants such as Miklós Hagyó.  In the former deputy CEO’s most recent testimony, however, stated that his incriminations were falsely made under duress from the investigators.  According to Regőczi, along with five other defendants, the interrogators coerced him to incriminate Miklós Hagyó and others with promises of easier pretrial treatment.

November 13th Hearing: Another Visit to the Testimony from Regőczi

On Tuesday, November 13^th, 2012 the trial of the Budapest Public Transport Company (BKV) continued in the city of Kecskemét, Hungary.  Miklós Hagyó, the primary defendant amongst the 15 accused, gave his thoughts on the testimony of Miklós Regőczi, BKV’s former deputy CEO of sales and communication.

Regőczi, who is accused of acting in a criminal organization which was allegedly led by Hagyó, stated in his testimony that the charges have been trumped up and the evidence provided to support the charges against Miklós Hagyó was falsely stated under controversial interrogations.  Regőczi also defended the contracts signed with companies such as Pont Ez Ltd. and WELL Advertising and PR Agency Ltd. noting that other publicly owned companies had executed much larger PR and marketing contracts, but those companies have never been scrutinized. 

According to the indictment, these companies were contracted to “improve the public image” of the public transport company, but the prosecution asserts that since BKV hold a monopoly in the public transport sector there was no need for such contracts and prodigal business. 

Regőczi also renounced previously made claims that Miklós Hagyó, the deputy mayor of Budapest and political supervisor of BKV from 2006 to 2010, never ordered him to affect contracts. 

Hagyó, in accordance with him being charged of running BKV as a criminal organization, is accused of forcing contracts with companies that were not operating in BKV’s best interest, but instead were politically or personally profitable for him.

The former deputy mayor recalled during the hearing on November 13^th that many other individuals were ordering the creation of contracts, but not him.  He listed György Tóthfalusi, a former SZDSZ representative, along with Ferenc Olti and Gábor Dancs.  “Neither me nor my colleagues had no right to give orders to the administration,” repeated Hagyó.

He also noted that even though these men oversaw the business between BKV and other contractors, none of them are suspects nor have they been witnesses during the trial.  “Though I’m of the persuasion that my political colleagues acted legally, their names appeared in the records as people who gave orders to the upper management of BKV, yet there is no investigation into their actions,” asserted the former deputy mayor.

November 8th Hearing: Defendants Respond to Regőczi’s Testimony

On Thursday, November 8^th, 2012 the previously stated testimony from the former BKV deputy CEO of communication and sales Miklós Regőczi was the hot topic in the Keckemét Tribunal. 

Regőczi was the first to speak during the hearing.  He continued to support the controversial marketing contracts which were previously deemed prodigal.  He defended the BKV marketing campaign which occurred under his supervision from 2007 until 2008 by list annual marketing expenditures from other public companies, notably the national railway system MÁV Ltd. which previously signed contracts worth nearly 1 billion forint. 

Regőczi, like many of the other defendants, partially renounced his previous accusations against the other defendants, saying that he was coerced into the accusations by the temptation to “go home” the night of interrogation.  Otherwise, it was implied, Regőczi would have endured a harsher interrogation.

Other defendants such as Ernő Mesterházy, political adviser to the former mayor of Budapest, and Atilla Antal, former CEO of the Budapest Public Transport Company, collectively agreed that the circumstances of their and Regőczi’s interrogations should be formally investigated. 

Miklós Hagyó and Zsolt Balogh, two of the main suspects in the case who did not speak at the hearing, both expressed experiencing similar duress during their interrogations.
