The Magical Nokia-box - part 3

What exploded the BKV-scandal?

Let’s jump back until July 23, 2009 when BKV-scandal exploded in connection with the dismissal pay of Szalainé Szilágyi Eleonóra, former HR director. Hagyó, who was on vacation at that time, immediately ordered an investigation in this case. According to Magyar Nemzet daily BKV concluded unnecessary contracts and paid excessive dismissal pays. Now we are aware of the fact the BKK still concludes these kinds of contracts so far. Of course the press barely wright about this and nobody has been arrested accordingly.

What did experts say about the necessity of the contracts?

Nothing. The prosecutor’s office considered these contracts as unnecessary and surplus so incriminated them. The prosecutor’s office did not ask experts to write their opinion. The indictment declared as fact – without experts’ opinion – that BKV’s marketing activity was totally unnecessary as the company was in monopoly position. On top of all that it was Hagyó who pointed at the unprofessional argument of the prosecutor’s office during the court trial. He namely asked the question that “who has transport engineering, metropolis public transportation-logistics and communication or marketing skills in the prosecutor’s office so he can decide and establish such a serious declaration?”.

BKV case: the prosecution quizzed an Olympic champion and a film director

On the Kecskemét Tribune on Thursday on the hearing of the BKV case, they heard as a witness Csapó Gábor who is an Olympic Champion and Kamondi Zoltán who is a film director. According to the standpoint of the accusation the sponsor of the sport and culture at the time of the former deputy lord mayor, Hagyó Miklós was unneeded and damage cause activity. Csapó’s Limited partnership signed with the BKV in 2008, with the value of 2,85 million forint.

And Csapó placed the BKV’s molino in his swimming school, and with the help of the parents they worked on the BKV’S logo on the kid’s sport supplemental. The Olympic champion told, that in his swimming school he raised 20 thousand young kids in 20 years, including 50 handicapped young kids in a year, and for whom they ensured the participation for free.

BKV case: they revised the indictment again

BKV case: they revised the indictment again
The defendants responded for the again revised indictment on the Thursday’s hearing of the Hagyó case on the Kecskemét Tribune. The prosecution several times revised the indictment which is already stands in weak legs, what Hagyó and his fellows during the investigation named it as „political pamphlet”. At this time they made the indictment softer in several places and now they are not writing about „orders” for unneeded contracts, now they are writing about „requests”.
In the indictment the amount of the damage – not at first during the process – changed again and similarly with the before ones, the prosecution had problems with the math again. More of the defendant and their lawyers said that the part amount of a few contract does not bring out the whole amount of the damage. Because of this they proposed that the prosecution present itemized that with amount they charge with which defendant.

(Source: taneszkozok.hu)
Z. Tibor defendant also said that in a big case like this the prosecution’s scuttlebutt place phrases in the indictment. With this he referred that in the „soft” indictment there is unusual shady/cloudy statement which says „they had to complete a request from an unknown leader of Budapest”. ” I never thought that in a strange story like this I will be the goldfish” – added Z. Tibor.
With the neediness of the communication contracts the defendants brought up the testimony of Bolla Tibor, who is the present CEO of BKV, when he said that for communication and marketing the transportation company still spends money. However the prosecution in the revised indictment states that the BKV has no concurrency, L. Otto defendant in his observation listed 11 path/line and alternative solution in the case of if „he has to go to the honored investigation prosecution” from his home.

On the Thursday’s hearing they heard the leader of the communication, Székelyné Dr. Pásztor Erzsébet, who is in this position at the BKV up to this day. Székelyné changed her testimony what she said years before with not remembering that she would have notice any signs for malfeasance with the defendants. She only alluded to the reason of the loosing of the trust is just that Kocsis István prosecuted in the case of the BKV contracts. From that matter Kocsis after his nomination as the CEO of the BKV proposed a leader position to Székelyné who now confirmed the standpoint of the defendants, which said that the BKV needed and still needs for communication and that the company is not monopoly in the field of the transportation of Budapest. She remembered for Z. Tibor defendant, her former employee as a scrupulous/conscientious labour/manpower.

A vádirat újabb módosítására reagáltak a vádlottak a Hagyó-per csütörtöki tárgyalásán, a Kecskeméti Törvényszéken.

A csütörtöki tárgyaláson tanúként meghallgatták a BKV mai napig a posztján lévő kommunikációs vezetőjét, Székelyné Dr. Pásztor Erzsébetet.

BKV case: the prosecution „freely handled” the documents

BKV case: the prosecution „freely handled” the documents
The prosecution kept back one testimony and changed another testimony in the documents of the BKV trial – turned out in the Tuesday’s hearing of the Hagyó trial in the Kecskemét Tribunal. The prosecution in the hearing – for the previous call from the court – attached 2, previously kept back documents. The records contain the investigation testimony of the former press person of Hagyó from the 3rd and 9th of February, 2010.
Around the 2 records the lawyers and the defendants attracted the attention for several anomalies. For the defense from these documents now it turned out that the record what the prosecution handed in now didn’t match with the copy.

In the case of the record what they made in the 9th of February, 2010 the prosecution simply kept back the document. Now, for the defense’s ask they handed in to the court, but in the review of the document they just „skipped it”. According to Kádár András, the lawyer of Hagyó from the interesting of the documents „several concludes can be made” and they will do it later.

Hagyó Miklós also thought it’s weird that although the Main Prosecution only started to refer to the range of the Central Investigation Main Prosecution from the 20th of May, 2010, the KNYF (Central Investigation Main Prosecution) already gave effect to investigation action earlier, on the 3rd of February. According to Hagyó’s opinion it’s surprising that the prosecution wanted to get in the case and– according to the statement of Hagyó’s former press person – ask for an incriminatory testimony with arm-twisting, on the day when the policemen already questioned the press person and who disinclined to accuse others wrong. According to Hagyó the paradox around the records suggest the suspicion of the forgery of the notaries document, „and this is strictly punished by the Penal Code.”

(Source: helyitema.hu)
On the Tuesday’s hearing the first hearing of a witness started. The summoned witness was Bolla Tibor, the present CEO of the BKV. The lawyers and the prosecutors bombed the leader of the Transport Company for hours with their questions. In every question Bolla verified and supported his predecessors, the defenses from the present defendants.
For answering of the prosecution’s questions Bolla said that the contract signing are often happens in a basis of the trust up to this day, and he is asked with favors in a form of recommendation. According to his testimony, he is working with these similarly to Antal Attila (his predecessor), he informs the leaders of the given professionals. For the question from the lawyers he reported that personally he doesn’t check every signed contract, for this – similarly to Antal Attila – he would have no chance.

Bolla with his answers one after the other denial the indictment’s statements (according to the defendants they think it’s unprofessional too). He firmed that the BKV sets kid’s days today too and other marketing events, they spend for communication and – in opposite with the statements of the prosecution – the company is not in monopoly status in the scope of the transportation of Budaoest. However Hagyó and his fellows were accused with several set up for events – tram with lights, Santa Claus, gift makings, etc. – according to Bolla, these are - up to this day - a part of the working of the company.

The balloons were needed for the police too

The balloons were needed for the police too

The BRFK also claimed for the „unnecessary” gift packages from the transportation company, but as it known according to the indictment of the Hagyó-case these are counts as a crime, the outlays for BKV gift objects.

The indictment of the BKV case – without took in a professional – said that the BKV marketing is unneeded because of the company’s so called monopoly, so they qualified the outlays for gifts as crime from the period of 2008. Contrarily the Police Station of the V. district in 2008 and also before, they requested the BKV gift packages – turned out from a letter which the Népszava got.

DSC_0039.jpg

In the letter it refers to a meeting which happened before with a police shave tail that they asked the BKV: „based on the previous years’ routine with gifts, flyers, shirts, product show-piece, sporting goods, books, gift packages, grocery, sodas, original equipments…etc” support the needy Elementary Schools for the Camp of the Transport and Felony/Guilt Prevention.

Hagyó Miklós and other defendants reminded us a few times that the prosecution called the money in the indictment unneeded what they spent on publicity, programs for kids, but the transportation company before them (and present) spend on marketing and on preparation for gifts. But temporarily the BKV’s marketing only counts as a crime in the time of Hagyó. Even though the police also asked for their own purpose from the gifts which „came from crime”.

A rendőrségnek is kellettek a BKV-s lufik

Még a BRFK is igényt tartott a közlekedési vállalat „felesleges” ajándékcsomagjaira,
holott a Hagyó-ügy vádirata szerint bűncselekménynek minősülnek a BKV
ajándéktárgyakra fordított kiadásai.

A BKV per vádirata - szakértők bevonása nélkül - kimondta, hogy a BKV marketing
tevékenysége, a vállalat állítólagos monopolhelyzete miatt teljesen szükségtelen, így
bűncselekménynek minősítették a 2008-as időszak ajándéktárgyakra fordított kiadásait is.

ügyészség a vádiratban szükségtelennek nevezte a közösségi közlekedés népszerűsítésére,
gyermeknapi programokra költött forintokat, holott a közlekedési vállalat vezetése
előttük (és jelenleg is) ugyanúgy költ marketingre, ajándéktárgyak előállítására. A BKV

The Santa Claus was the subject in the BKV trial

The Santa Claus was the subject in the BKV trial
The prosecution asked one of the defendants (who are a former subcontractor of the BKV) about Santa Claus costumes, crayons and about chocolates on the yesterday hearing of the Hagyó case.
M. László journalist, XII. accused – who is accused by the prosecution with misappropriation as a privy, with the contracts between the BKV and his company – denied his guiltiness. According to the accusation the programs for children day, the BKV Santa Claus and the campaign for the transport security which was set up by this company were unneeded, H. Éva accused VI. was the one who ordered the signing of the contract, who in that time was in a relationship with him, and now he is her husband. M. László said, that his wife was working as an advisor on the project of the subway 4, she had no right and no opportunity for ordering. For that matter he said that these programs were useful and successful.

(Source of the photo: http://www.minitoys.hu)
On the hearing the prosecution’s questions with among others about the Santa Claus costumes made in the defendants and their defenders a general exhilaration. On the hearing this was the first time when the prosecutor answered for the observations which disapprove the work of the accusation, these observations were that on the selection when they chose the defendants they chose it by politics. According to the prosecutor this is not true, they accused people about they had incriminatory testimonies during the investigation. This answer – considering that they didn’t even questioned the so called „sources” of the slush-fund – pique big outcry in the defendants and in their defenders.

October 30th, 2012: More Interrogation Controversy

October 30th, 2012: More Interrogation Controversy

The BKV hearing on the Tuesday, October 30th, 2012 presented the testimony from Ottó Lelovics, the former campaign manager and public relations specialist to main defendant Miklós Hagyó.
Lelovics’ testimony has been rather consistent with those given by the other defendants: he was subjected to threats of harsher treatment from the interrogators unless he provided appropriately placed accusations.
Also like the other suspects Lelovics pleaded innocent of forcing any BKV employee to sign feckless contracts.  In fact, according to the former campaign manager he was never employed by BKV nor any other public company and he committed no crimes, unless you count the three unregistered bullets in his home which were discovered by police when they searched his home.  Accounting for those, he said that they were encased in remembrance of a deceased hunter.
During the hearing Lelovics recalled how he was contacted while at his parents’ vacation home by a phone call from the investigators.  Thereafter he was to make his way to meeting with the police where he was subjected to his first questioning.  According to the fifth defendant, the police searched his home and then left, but only after an eerie comment was made by one of the officers.  “Take a lot of stuff because you’ll be in for a long time,” is what Lelovics said he heard.
Months later, the suspect was required to undergo another period of interrogation, but he said this time the environment and circumstances were much more intimidating.  Lelovics claimed, “In the center of the city during broad daylight they handcuffed me, they leased me, and we were standing there for an hour.”
After this, the former public relations specialist was placed in pretrial detention where he remained for another six months.
Similarly to the primary defendant, Miklós Hagyó, Lelovics arrived in court with BKK merchandise.  While showing the court the items which included playing cards, bags, and pens, Lelovics inquired to the court to consider the necessity of producing such marketing material when BKK and BKV have a monopolistic hold on the public transportation industry.  Like Hagyó, Lelovics demanded to know how could contracts with companies which were improving the technology of the public transport be considered wasteful spending when one considers the incurred cost of producing the marketing merchandise.
Lelovics concluded his testimony by providing a quote from the former mayor of Budapest Demszky Gábor: “It was a composed and planned series, which was made for a political purpose and they have achieved that purpose.  I think it’s unforgivable, that they mired dozens of people and they suspected them and they have denigrated them.

October 25th, 2012 Hearing: Beach balls, Balloons, and Bouts

October 25th, 2012 Hearing: Beach balls, Balloons, and Bouts

The BKV hearing on Thursday, October 25th provided various sorts of drama.
For starters, Miklós Hagyó, the primary defendant in the case continued in his persistent attempt to disprove the accusations against him from his principal accuser Zsolt Balogh. Although Balogh had seemingly made Hagyó’s task easier by previously admitting under oath that his accusations were falsely given, the indictment against Hagyó still stands.
During the hearing, Hagyó, the former deputy mayor of Budapest and socialist MP, made his way through an itemized list of dates and events connected to the accusations and infamous Nokia box story.  The former deputy mayor became emotional  when he berated the prosecution for omitting documents from the case file which, Hagyó claimed, would contradict the charge of misappropriation of public funds.  According to the defense, the documents in question displayed the financial relations between BKV, MKB (the Hungarian Central Bank), and various companies who received contracts from BKV.
Synergon and CCsoft have been two of the companies receiving much of the legal attention.  CCSoft was employed to create a passenger information system which would have consisted of overhead monitors displaying travel information at the stops within the Budapest metro system.
Zsolt Balogh, who in 2008 served as the interim CEO of the Budapest Public Transport Company while Hagyó was the political supervisor, accused Hagyó of forcing him and other employees to sign contracts such as the one with CCSoft.  Balogh originally stated the contracts were thriftless for BKV but personally or politically profitable for Hagyó.
Hagyó’s responded during the hearing on the 25th by presenting to the court a few items of BKK merchandise such as beach balls and balloons.  BKK, the Center for Budapest Transportation, is the parent organization of BKV.   According to Hagyó, he obtained the merchandise for free at a public relations event.  The former MP asked the court how the contract for the passenger information system was unnecessary spending of public money when one considers the beach balls and balloons.
According to Hagyó the bank records are not the only potentially important types of evidence which have been omitted by the prosecution.  He demanded to know from the prosecution why the directors of Synergon and CCSoft have not been questioned about their respective relationships with BKV and Miklós Hagyó.  According to the defendant, if he stands accused of forcing corrupt contracts with these companies and misappropriation of funds then why are bank records and other testimonies not in the case file.
Upon hearing this, the judge requested that this evidence be presented to the court.

What is this, if not marketing?

What is this, if not marketing?

According to one of the momentum in the indictment against Hagyó Miklós, in general the propagation of the BKV’s service is not giving any substantive gain for the company, and the liability for this is absolutely unneeded. According to his reasoning „”the BKV in the field of the public transportation of Budapest are a company in the position of monopoly, which services are known for the purpose audience, for the users of the public transportation in the capital has no other choice in the sphere of the requisition, BKV does not have any contestant

As we already reported earlier, this statement in the sight of the profession is sherry wrong statement, the BKV has a contestant/rival, and however we are not going to angle our post for this.
But: we mentioned that in the end of the 25th of October’s hearing, Hagyó from his bag drawed different souvenirs with the logo of the BKK, proved with this that the BKV today still spend money on marketing. According to his telling, he got this objects from a kid, who got these gifts at a PR event which was supported by the BKK, at the event of the Week of Mobility 2012, on a boat trip. Along with miscellaneous he gave to the court a few balloons, a beach ball, a shawl for cleaning the glasses, shirt, mug, and other objects which had the logo of the BKK which lead by Vitézy and which objects were ordered from public money.
On the 30th of October, similarly to his former boss, Lelovics Ottó, the 5th accused of the BKV case also arrived to the court with souvenirs which had the logo of the BKK (Centre for Budapest Transport). The same as Hagyó, he also traversed the indictment’s statement that the BKV thinks it’s unneeded to spend on marketing because of the position of monopoly. For presenting this, he showed two BKK’s pack of card game, puzzle, pouch/bag and pen, what objects he bought before the hearing at the BKV Store on the Deák Square.
And now, let’s see the true pearl: if you click on the hereunder work/creation, according to the performers it could have not been finished without the support of the BKV and BKK. This also proves that the managing/leaders of the BKV think that the marketing is important, be whatever is it…
