If it is up to the prosecutor, Hagyó will be never released

According to the prosecution authority in case of eight accused the charge of continuous breach of fiduciary duty through organized crime is factual therefore the prosecutor requested for their heavy prison sentence and the exclusion of their release on parole in his prosecutor speech.

In case of Miklós Hagyó, Attila Antal, Zsolt Balogh and Miklós Regőczi the fact that the sentence for engagement in organized crime was raised from 20 to 25 years has not only theoretical significance – said Prosecutor János Homonnai representing the Prosecution - when at the end of his prosecutor speech he itemized the charges against each accused and the sentences he is requesting for them after closing the prosecution’s case-in-chief at first instance. According to his opinion in case of Miklós Hagyó, Ernő Mesterházy, Attila Antal, Zsolt Balogh, Miklós R., Ottó L., Éva M.-H. and Miklós H dr. the charge of engagement in organized crime – threatening the accused with double sentence – and the act of causing continuous and extraordinary material loss are well-based.


Most of the accused are charged with aggravated breach of fiduciary duty – some of them are charged as offenders, some of them are charged as instigators and others as abettors. Besides, Miklós Hagyó is charged with two counts of abuse of authority and two counts of bribery committed as an executive official. Besides breach of fiduciary duty, Attila Antal, Zsolt Balogh and Miklós R. are charged with more counts of falsification of private documents, as well. The rest of the accused are also charged with breach of fiduciary duty and falsification of private documents without the fact of engagement in organized crime.

When did BRFK start the investigation?

Although there were no condemning investigations at BKV before 2008, BRFK entered the campaign in 2010. One day after Hagyó resigned from BKV’s supervisory board Gábor Tóth police chief informed the transporting company about continuing criminal procedure. Police initiated the arrest of Szalainé 90 days prior to the elections and kept on accusing BKV persons. The investigation landed in the hands of Hagyó’s former political rival: György Pető used his position to recruit managers of some companies owned by the capital before the municipality elections, who were supposed to be informants to the police.



There were really no condemning internal investigations at BKV?

Really there were not. Two internal investigations stated in 2008 that all the contracts of the affected period are ok. Supervisory Board accepted the investigation of the Internal Supervisory Department on October 16, 2008 with respect to that those reports contained the entire advisory circle and there were no ascertainments that would have requested further steps to take. The general meeting of 2008 accepted Zsolt Tiba’s report (capital clerk) with the attachments which were reports on the contracts between BKV and AAM Zrt.

They can start the Hagyó case from the beginning



There is still no owner for the notorious crimes, for the BKV scandal, for the 15 billion MVM misappropriations or for the Sukoró case. All of these were started in the countryside, but after the decision from the Constitutional Court about the case transferences, the cases had been stopped, because the courts in the countryside didn’t keep being competent anymore. 

The special cases can be stopped for maximum 3 months without consequences. By this time we already overstepped the 3 months round, so it seems like that now it doesn’t matter anymore that what court will be the competent, they have to start over all the special cases.

The arguments about the unclaimed notorious cases came so far for now that – it seems like – that it sure that they have to start them over, independently from that fact that in which court will the cases continue. These are those difficult, big cases what the transferred to countryside court because of the workload of the Budapest’s court: such as the BKV scandal which was transferred to Kecskemét, or the former MVM leader, István Kocsis’s 15 billion misappropriation case which started in Kaposvár. The status of these cases fell over when the Constitutional Court in the beginning of December said that the former law which was the basis of the case transferences was unconstitutional and it had been already repealed. First it said that the decision of the Constitutional Court doesn’t influence the pending cases because the Constitutional Court rejected the proposal when they asked the extermination of the dockets of the transferences.

Coercion interrogations, magisterial malfeasances in the Hagyó case – WITNESSES (5th part) – RELOADED


In the hearings period of the BKV case, which is became called as the Hagyó case, the defendants and the witnesses in the case recalled their testimonies which was the biggest storm stirred

A lot of them referred to the fact that during the investigation against the Public Transportation Ltd. of Budapest and against a few former leaders of Budapest there happened several magisterial malfeasances. Ones reported about coercions, others revealed a lot of malpractices from the police during the investigation.

The police documents are bristles from the caveats. The defendants brought the attention to the court for falsely dated, lost documents and for documents which can have the forgery suspicion.

That is how they triald the accuseds of the BKV-case

The criminal suit, what noted as the airport graft continued in the court with the prime suspect's hearing. According to György Sz. mind the investigation was conceptional. György Sz. used to be the legal executives of the Budapest Airport (BA) in 2008 and 2009, after he commited corrupt practices many times as the legal manager of the BKV Inc. Sz. according to the prosecutor's mind contributed in the over-billed order-contacts which were injured the two big firm's economical interests, and in exchange for this, he received severeal ten million forint slush-fund.




According to one of the counts György Sz, one of the legal executives of the BA INC. and the direct superior, the secondary co-defendant, Krisztina V. R. legal director at the end of 2008- at the beging of 2008 decided, that she ask for illegitimate profit for the owing total what comes from the legal exercises doing's order contracts which are based in the solicitor's office, mostly the order fee's 5-10 percent.

Former CEO of BKV Is In The Hot Seat

On March 5th, the Kecskemét Tribunal in Hungary saw the continuation of the trial of the Miklós Hagyó and 14 other defendants associated with the Budapest Transit Company (BKV).




The hearing was fairly mundane – not much fresh information was presented.

The most interesting occurrence, though, involved Mr. István Kocsis. He was promoted to CEO of the transit company immediately following Zsolt Balogh’s time in the high seat. Kocsis therefore was responsible for transferring the demanded BKV-related data to the investigation authorities. Included in the submitted material was an internal audit of BKV’s operations. According to Erzsébet Székelyné, the current director of communications at BKV, the audit ordered by Kocsis was hastily created. She stated in court during the March 5th hearing that because of the imposed sense of urgency around the audits, they were not “substantial.”

Székelyné Pásztor Erzsébet had to answer for embarrassing questions (who is the present responsible director of the social communications) on the yesterday hearing of the Hagyó case on the Kecskemét Tribune. The defendants with the questions what they asked from their former colleague they unambiguously tried to prove that in the background of the expedition/campaign which is against them it’s Kocsis István the former CEO of the BKV.

Székelyné admitted that for the inside audits/inquires which established the accusations of Kocsis they had little available time and in more case the audit/inquiry could not be substantial. She mentioned as an example that they had dismissed audit results in a case in which – although they couldn’t find entire documentation – on the internet it can be still found the typographical turnouts which proves the compliance of the contract.

As it known the height of the BKV scandal was the accusations from Kocsis István and the investigation process which was the consequence from that. Székelyné admitted that Kocsis István before proposed a leader position and they already worked together before in the nuclear power station of Paks. During the investigation Székelyné made incriminatory testimonies against the more of the defendants. Now she admitted that the transportation company did and does the communication tasks what the prosecution consider as crime in the case of Hagyó and his fellows. For answering the questions she said that up to this day they vend BKV (and BKK) souvenirs what return profits for the public transportation company. She firmed that under her leadership they sponsored sport and culture and they signed contracts with the same companies in several cases as the defendants before. 

Székelyné firmed the thereon standpoint of the defendants in the questions which is connected to the Well Ltd. (and which is a basically influential accusation) that the campaign of the Combino and the other assignments weren’t unneeded. She stated that there were only form mistakes in the documentation, by this time she didn’t talk about the suspicion of malfeasance. Moreover, she so firmed that she also extended contracts with the Well Ltd. but she doesn’t remember for 2,5 or 5 million net/month. The defendants in the break of the hearing talked about that they don’t think it is a coincidence that Székelyné since the departure of Kocsis from the BKV „she forgot a lot and now she is in the same professional opinion with the defendants”.

According to them Székelyné in the time of the expels and accusations she was acting on as the trust person of the former CEO and with her testimonies and statements she acted on the expectations from Kocsis, but now she doesn’t have that strong defense. The responsible director of the social communications didn’t deny that in that time she followed all the orders from her former boss.

The prosecution accused Kocsis István the former CEO of the MVM (Hungarian Electricity Ltd.) and his 5 associates with 15 billion forint misappropriation which caused asset/property disadvantage. Their trial started yesterday on the Kaposvár Tribunal, reported the kapos.hu. According to the accusation Kocsis and his associates pumped the money of the Electricity through foreign companies. The prosecutor said as an example that they paid 44 million forint for an Austrian company for a 3 page long presentation, in where they presented a Novi Sad and an Albanian thermal power station. Kocsis denied the accusations, according to him at the time of his running the Hungarian Electricity Ltd. was successful and if they didn’t dismiss him in 2010 and if they didn’t stop the investments what are in the accusations it would have bring profit.
