Hagyó won a battle


In Strasbourg they adjudicated in the case of Hagyó Miklós, who is the main defendant in the BKV case. The European Court of Human Right adjudicated a few million forints compensation for the former deputy lord mayor, as they said: the authorities who restrained him violated the prohibition of the inhuman treatment and for the personal freedom, together with right of the legal redress/remedy. During this Handó Tünde, the president of the National Judicial Office strove/tried to explain the transference of the Hagyó case in front of the Constitutional Court.


The Hungarian authorities did multiple violation of law at the detention of Hagyó Miklós – said yesterday the European Court of Human Rights, therefore they obligated the Hungarian government to pay out 12.500 euro relief – this is 3,75 million forints – and 6000 euro law cost – further 1,8 million forints. The former deputy lord mayor who is the I defendant of the BKV case which is in the Kecskemét Tribunal turned to Strasbourg in 2010, because according to him they put him into pretrial detention unduly, and extended his duress provision several times. 





According to Hagyó’s statement, “it would have been far it from me/ I never wanted to escape to abroad” and he cooperated with the authorities from the beginning. Hagyó was in pretrial detention from May 2010 until February 2011, then they put him into house arrest, later they alleviated/relieved this too and in the criminal suit which started last summer he could defense himself at large/freely. In his complaint about the violation of law with his detention Hagyó stated: the court didn’t explained properly the necessity of the detention, furthermore they restrained his relationship with his partner. The court in their verdict they stated that the Hungarian authorities violated the European Convention on Human Rights – said to our newspaper, Kádár András, the lawyer of Hagyó. For example the prohibition of the inhuman treatment they violated it, because Hagyó who had respiratory system health problem they only allowed him for a long time to go out from his cell for only one hour per day, they only raised the time on the fresh air only after half a year – and they even had medical indication. According to the court this goes beyond on the trials what someone who is in pretrial detention should necessarily suffer. 

The court saw that the violation of the personal freedom is proved with, that a long pretrial detention like this wasn’t based on the serious criminal suspicious. Even if it’s enough reason in the beginning of the process, later for the extension of the pretrial detention it’s not. The court thought that the extensions contained “stereotype reasoning’s”, they didn’t considered the facts of the case and Hagyó’s cons. (Interesting, that Szívós Mária is the Constitutional Judge from 2011, the Szívós Mária who in that time continuously extended Hagyó’s pretrial detention.) The court emphasized: the allegedly proof what supported the purpose of Hagyó’s escape never turned up and Hagyó couldn’t even learn/know that. 

The court eluded: the court that is deciding about the pretrial detention has to support the “weapons equality” between the prosecutor and the restrained person. This principle is not ensured if the lawyer couldn’t get the documents – explained Hagyó’s lawyer. (With another decision from Strasbourg where came out also yesterday, in the last weeks the verdicts number where they said out the responsibility in the understanding of the weapon equality from Hungary grew up to 4 – the editor.)


The right to be observant of someone’s personal- and family life it’s also violated in Hagyó’s case with that the prosecution prohibited in the last 3 months of the detention the communication in person and on the phone between Hagyó and his partner with the reference of a false authority. Since that both of them were released from this charge. In the connection of this the court also established that Hagyó’s right for legal redress also violated, because his complaint about the decision of this communication with his partner what was prohibited by the prosecution decision was never considered. 

Handó: the transference was legal

As a legal dispenser the president of the National Judicial Office always proceed with the all day updated law, she did like that with the transference of the BKV case – know the National Judicial Office in their publication. The organization gave a tight-lipped communiqué after the leader of the National Judicial Office, Handó Tünde (the wife of Szájer József who is a Fidesz party representative in the European Parliament) was in a hearing at the Constitutional Court, since the corporation check that the transference rules are in accord with the basic law. Handó asked for the hearing after she gave an answer in writing - for that matter this was the first time in the history of the Constitutional Court, but they hold in behind closed doors. (This is violating the publicity of the public power decision, the right for the free access of public interest according to the Eötvös Károly Institution, the Hungarian Helsinki Committee and the Hungarian Civil Liberties Union.)

The president of the National Judicial Office “presented that the transference of a case is happening in what process system and on based on what objective standard did she make a decision”. For that matter Hagyó also has a proposal about this case in Strasbourg: he raised the question of the violation of the right for a legal judge, wherefore she transferred the case from the capital to Kecskemét. In his proposal to Strasbourg Hagyó also adduced that in the case of the transference they made the decision without the support of the legal remedy – because for this in that time wasn’t a legal opportunity. The Constitutional Court reversed the temporary provisions/mandates, which made the opportunity for the case transference, ex post facto in December of 2012. However the Fidesz didn’t yield from this power, and they simply put in these provisions/mandates into the basic law. 

They wanted an incriminatory testimony against Demszky

The former main lawyer of the transportation company, Sz. György said that he is a victim in a show trial and in his questioning they only wanted to gouge incriminatory testimonies out of him against Hagyó Miklós, Demszky Gábor (in that time he was the lord mayor) and against the leader of the BKV, Kocsis István. Now he is standing in front of the court because of bribery and other crimes. In the bribery case, which is connected to the Budapest Airport (BA) Ltd, Sz. György made his testimony on the Tuesday’s hearing.

According to the report of the atv.hu, he denied that as the legal rapporteur of the Budapest Airport together with his boss, with the also defendant R-V. Krisztina, they together got back slush fund for the assignments from the law offices which had contract with the company. Sz. György is charged in another count, that as the legal director of the BKV he together with F. Zsolt, who was the former informatics director at the transportation company, they got back money from a 28 million forint project. Sz. György was dived when he received 11.8 million forints in December 2009. Sz. György and F. Zsolt (who they arrest after a few month hiding) denied that that money was soap. But Sz. György admitted that in the informatics project of the BKV he stacked mistakes onto mistakes, and because of this he is loaded with responsibility. 

The Hungarian authorities violated:

- The prohibition of the inhuman treatment

- Hagyó’s right for the personal freedom

- Hagyó’s right for the respect of his personal- and family life

- The right for the legal remedy

Ítéletet hirdettek Strasbourgban a BKV-per fővádlottja, Hagyó Miklós ügyében; az Emberi Jogok Európai Bírósága többmillió forintnyi kártérítést ítélt meg a volt főpolgármester-helyettesnek, mondván: az őt fogva tartó hatóságok megszegték az embertelen bánásmód tilalmát és a személyi szabadságához, valamint a jogorvoslathoz való jogát. Eközben az Országos Bírósági Hivatalt vezető Handó Tünde Hagyó perének áthelyezését igyekezett magyarázni az Alkotmánybíróság előtt.


Többszörös jogsértést követtek el a magyar hatóságok Hagyó Miklós fogvatartásakor - mondta ki tegnap az Emberi Jogok Európai Bírósága, ezért 12 500 euró kártérítésre - ez 3,75 millió forint - és 6000 euró perköltség - további 1,8 millió forint - megfizetésére kötelezte a magyar államot. A Kecskeméti Törvényszéken zajló BKV-per elsőrendű vádlottjaként a volt főpolgármester-helyettes még 2010-ben fordult Strasbourghoz, mert szerinte indokolatlanul helyezték előzetesbe, majd hosszabbították meg többször a kényszerintézkedését.

Hagyónak állítása szerint "esze ágában sem volt külföldre szökni", és a kezdetektől együttműködött a hatóságokkal. Hagyó 2010 májusától 2011 februárjáig volt előzetesben, majd házi őrizetbe helyezték, később ezt is enyhítették és a tavaly nyáron kezdődött büntetőperében már szabadlábon védekezhetett. A fogvatartását érintő jogsértésekről szóló panaszában Hagyó azt is állította: fogvatartásának szükségességét nem indokolta megfelelően a bíróság, továbbá korlátozták kapcsolattartását az élettársával. A bírósága ítéletében megállapította, hogy a magyar hatóságok megsértették az Emberi Jogok Európai Egyezményét - mondta lapunknak Kádár András, Hagyó védője. Az embertelen bánásmód tilalmát például azzal, hogy a légúti betegségektől szenvedő Hagyó sokáig csak napi egy órára hagyhatta el zárkáját; a friss levegőn töltött időt - az orvosi javallat ellenére - csak fél év elteltével emelték meg. Ez a bíróság szerint túlmegy azon a megpróbáltatáson, amelyet szükségszerűen el kell szenvedni egy előzetes fogvatartottnak.

A személyi szabadság sérelmének megsértését a bíróság abban látta bizonyítottnak, hogy ilyen hosszú előzetest nem alapoz meg a súlyos bűncselekmény gyanúja. Még ha az eljárás elején ez elég indok is, később az előzetes meghosszabbítására már nem. A bíróság úgy találta, a meghosszabbítások "sablon-indoklást" tartalmaztak; nem vették figyelembe az ügy tényeit és Hagyó ellenérveit. (Érdekesség, hogy 2011 óta alkotmánybíró az a Szívós Mária, aki bíróként annak idején rendre meghosszabbította Hagyó előzetesét.) A bíróság kiemelte: az állítólagos bizonyíték, amely Hagyó szökési szándékát támasztotta alá, soha nem került elő, azt Hagyó meg sem ismerhette.

A bíróság kitért arra: az előzetesről döntő bíróságnak biztosítania kell a "fegyverek egyenlőségét" az ügyész és a fogva tartott között. Ez az elv nem biztosított, ha az ügyvéd nem fér hozzá az iratokhoz - magyarázta Hagyó védője. (Egy szintén tegnap, egy másik magyar ügyben hozott strasbourgi ítélettel az utóbbi hetekben négyre nőtt azon verdiktek száma, amelyek kimondták Magyarország felelősségét a fegyveregyenlőség elve megsértésében - a szerk.)

Sérült Hagyó magán- és családi élet tiszteletben tartásához fűződő joga is azzal, hogy az ügyészség a fogvatartás utolsó három hónapjában megtiltotta Hagyó és élettársa személyes és telefonos kapcsolattartását egy hamis meghatalmazásra hivatkozva. Azóta mindkettejüket felmentették az ezzel kapcsolatos vádak alól. Ehhez kapcsolódóan állapította meg a bíróság azt is, hogy sérült Hagyó jogorvoslathoz való joga, hiszen az élettársával való kapcsolattartást megtiltó ügyészi döntéssel szembeni panaszát nem bírálták el.

Handó: jogszerű volt az áthelyezés

Jogalkalmazóként a mindenkor hatályos jogszabályok szerint jár el az Országos Bírósági Hivatal (OBH) elnöke, így tett a BKV-per áthelyezésekor is - tudatta közleményében az OBH. A szervezet azután adott ki szűkszavú kommünikét, hogy az OBH-t vezető Handó Tünde - Szájer József fideszes EP-képviselő felesége - tegnap személyes meghallgatáson volt Hagyó perének áthelyezése miatt az Alkotmánybíróságon (Ab), mivel a testület azt vizsgálja, hogy az áthelyezési szabályok összhangban vannak-e az alaptörvénnyel. Az Ab-nak küldött írásos válasza mellett Handó maga kérte a meghallgatást - erre egyébként először volt példa az Ab történetében, de azt zárt ajtók mögött tartották. (Ez az Eötvös Károly Intézet, a Magyar Helsinki Bizottság és a Társaság a Szabadságjogokért szerint is sérti a közhatalmi döntéshozatal nyilvánosságát, a közérdekű információkhoz való szabad hozzáférés jogát.)

Az OBH elnöke "bemutatta, hogy az ügyek áthelyezése milyen eljárási rend szerint történik, milyen objektív mérce szerint hozott döntést az ügyekben". Hagyónak egyébként ebben az ügyben is van egy beadványa Strasbourgban: a törvényes bírához való jog sérelmét veti fel, amiért a fővárosból Kecskemétre helyezte át perét. Strasbourgi beadványában Hagyó arra is hivatkozott, hogy az áthelyezési döntést esetében a jogorvoslat biztosítása nélkül hozták meg - erre ugyanis akkor még nem volt jogi lehetőség. A peráthelyezésre lehetőséget adó átmeneti rendelkezéseket amúgy az Ab 2012 decemberében visszamenőleges hatállyal megsemmisítette. Csakhogy a Fidesz ebből a jogkörből nem engedett, és a rendelkezéseket egyszerűen beemelte az alaptörvénybe.

Terhelő vallomást akartak Demszkyre is

Koncepciós per áldozata, a rendőrök a kihallgatásakor pedig csak Hagyó Miklósra, Demszky Gábor akkori főpolgármesterre és a BKV-t vezető Kocsis Istvánra akartak belőle terhelő vallomást kicsikarni - állította Sz. György, a közlekedési cég volt főjogásza, akit vesztegetés és más bűncselekmények miatt áll bíróság előtt. A Budapest Airport (BA) Zrt.-vel összefüggő vesztegetési ügyben Sz. György a keddi tárgyaláson tett vallomást.

Az atv.hu beszámolója szerint tagadta, hogy a BA jogi referenseként ottani főnökével, a szintén vádlott R-V. Krisztinával együtt a céggel szerződött ügyvédi irodáktól kenőpénzt kapott vissza a megbízásokért. Sz. Györgyöt egy másik vádpontban, mint a BKV volt jogi igazgatóját vádolják azzal, hogy F. Zsolttal - a közlekedési cég akkori informatikai vezetőjével - együtt egy 28 milliós informatikai projektből pénzt kapott vissza. Sz. Györgyöt 2009 decemberében érték tetten 11,8 millió forint átvételekor. Azt Sz. György és a néhány hónap bujkálás után elfogott F. Zsolt is tagadta, hogy ez vesztegetési pénz lett volna. Sz. György azt viszont elismerte, hogy a BKV-s informatikai projekt ügyében hibát-hibára halmozott, ezért ebben felelősség terheli.

A magyar hatóságok megsértették:

- az embertelen bánásmód tilalmát
- Hagyó személyi szabadságához fűződő jogát
- Hagyónak a magán- és családi élet tiszteletben tartásához fűződő jogát
- a jogorvoslathoz való jogot
