The official people who works in the BKV case can get 10 years


The bill submitted by MSZP not long ago would punish official people with the possibility of 10 years imprisonment – that way also the prosecutors and the investigators working on the BKV case – who produce made-up evidences or if they participate in this action with malfeasant tools.





The defendants and witnesses involved in the BKV case during the hearing reported one after the other that they’ve made their previous testimonies which were incriminatory to others under humiliating circumstances, directionally, coercion interrogations as a result of the interrogating investigators’ and policemen’s threats.

Even Zsolt Balogh, the case’s key witness and at the same time defendant also admitted that the reason behind his incriminatory statements (for example about the Nokia box) during the election campaign was that he wanted to meet the expectations and to avoid jail. “I’m not a hero, I didn’t want anything else just to go home” – he confessed before the court.

The goal of the bill submitted by Mesterházy and the others was to push back the practice of the conceptual processes with political interest, so that the plea bargain would serve the law enforcement and not the political interests. According to their justification during the three year governance of the Fidesz-KDNP countless abuses came to light, including the illegal use of the tools of criminal proceedings. Witnesses and defendants who were persecuted and threatened in the conceptual lawsuits and plea bargains with political interest show the way that the current government is taking. In multiple cases - as also in the Hagyó case – it became clear that especially the prosecution doesn’t mind choosing any methods if it’s about a political order.


The acceptation of this bill by the parliament would be really bad news for the authorities acting in the BKV case. Under the followings they could get 5 to 10 years of imprisonment for taking part in an illegal process. The illegality of the process in the BKV case is constantly supported by every defendant’s and several witnesses’ in court testimony.


The bill dated on 16th September 2013 would complement the year of 2012 C. law regarding the Penal Code with the followings:

Az MSZP által nemrég benyújtott törvényjavaslat akár 10 évig tartó szabadságvesztéssel is büntetné azokat a hivatalos személyeket, – így a BKV-ügyben eljáró nyomozókat és ügyészeket is - akik koholt bizonyítékokat állítanak elő, vagy ebben jogellenes eszközökkel közreműködnek.





A BKV-ügyben érintett vádlottak és tanúk ugyanis a per tárgyalásán sorra számoltak be arról, hogy korábbi, másokra nézve terhelő vallomásaikat az őket kihallgató nyomozók és rendőrök fenyegetésének hatására, megalázó körülmények között, irányítottan, kényszervallatás során tették.

Még Balogh Zsolt, a per koronatanúja és egyben vádlottja is beismerte, hogy a választási kampány során azért tett terhelő nyilatkozatokat, (így például a Nokia-dobozról), hogy megfeleljen az elvárásoknak, és elkerülje a börtönt. "Nem vagyok hős, nem akartam mást, csak hazamenni" – vallotta be a bíróság előtt.

A Mesterházyék által benyújtott törvénymódosítás célja, hogy visszaszorítsa a politikai érdekből folytatott koncepciós eljárások gyakorlatát, hogy a vádalku a bűnüldözést és ne a politikai érdekeket szolgálja. Indoklásuk szerint a Fidesz-KDNP három éves kormányzása alatt számtalan visszaélésre, a büntetőeljárás eszközeinek törvénytelen alkalmazására derült fény. A koncepciós perekben meghurcoltak, fenyegetett gyanúsítottak és tanúk, politikai érdekből kötött vádalkuk mutatják azt az utat, amelyen a jelenlegi hatalom jár. Már több esetben - ahogy a Hagyó-ügy esetében is - kiderült, hogy különösen az ügyészség nem válogat az eszközökben, ha politikai megrendelésről van szó.

Ha az Országgyűlés elfogadja ezt a törvényjavaslatot az elég rossz hír lesz a BKV-ügyben eljáró hatóságoknak. Az alábbiak értelmében akár 5-10-évig terjedő börtönbüntetést is kaphatnak a jogtalan eljárásban való részvételért. A BKV-ügyben folytatott eljárás jogtalanságát pedig folyamatosan támasztja alá minden vádlott és több tanú bírósági vallomása is.

A 2013. szeptember 16-án kelt törvényjavaslat a Büntető Törvénykönyvről szóló 2012. évi C. törvényt a következőkkel egészítené ki:
