BKV case: Hagyó contests the basis of the indictment

On the hearing of the BKV case on Tuesday Hagyó Miklós was responded for the investigation testimonies what Balogh Zsolt already unsaid, and which was the basis of the indictment. As it known, Balogh unsaid his investigation testimonies (the same as Antal Attila and Mesterházy Ernő did), according to his statement, he was saying those things, because of the pressure of the investigators. The unsaid testimonies were read out on the hearings so Hagyó responded on them.

In his introduction Hagyó found fault with that the counsel didn’t take notice of his testimonies what he said in pre-trial detention, and what he proved with documents, while  they thought that Balogh’s statements (who was at large/wasn’t in pre-trial detention) are enough to establish the indictment, even when his testimonies were document counter and variance.

With his relationship with Balogh Zsolt Hagyó nailed down, that he never wield any decision, order, nor employer rights on him, moreover not even the Local Government of Budapest or anyone from there had the power over Balogh Zsolt, so he couldn’t order him anything. Hagyó thought it is important to pick up, that meanwhile Balogh named a lot of communication contracts unneeded, in his testimony he pen like this: „I had a good vision/view for a big aspect as a Technological/Engineering deputy CEO, but I didn’t know the economic, personal issue, transportation/vehicular and communication aspects.  ”

Hagyó also pan out about Balogh’s thereon statement, what he already did on the hearing, that the politician a lot of times ordered him for „raport” („questioning from a boss at a company”, mostly because of a „going-over/wig”) and he yelled at him. „This statement is solely relevant, that with the interest of the tasks what were momentous and hastily disposed, he necessitated Balogh Zsolt, as he did the same with the competent professionals, that he should do his task with the work of his best knowledge. Accordingly, if we had profession conciliation/compliance a lot of times, if I raised/pull up my voice, if I rushed him to do some of his tasks, then this pressure only happened to suit the requirements from the Local Government of Budapest and from the people who are living in Budapest and to observe some deadline. ” – he said. 

Hagyó also referred to, that Balogh in truth didn’t scare of him, he couldn’t even be scared of him. He brought up that on Balogh’s questioning as a witness on the 8th of February, 2010, so at the time when Hagyó as a member of the parliament had a right of immunity and he was at large/not in jail or pre-trial detention, for the question of the investigations that he would like to have a personal protection for the defense of his life, his body intact (protect his body), and his personal freedom, he answered „I don’t want the personal protection support”. Later, on the 14th of September, 2010 he said, while Balogh said that in that time they didn’t meet for more than a year, and according to his statement Hagyó didn’t search him not even directly and not even indirectly, he didn’t do anything against him which could give any reason for fear, he said the statement that he is scared from Hagyó. „From me, who was in imprisonment for months, who he could see in anguished/mortified, in fetters, in limitless defenselessness, surrounded by investigators.” – drafted the politician.

Hagyó Miklós a vádirat alapját jelentő, azóta visszavont Balogh Zsolt-féle nyomozati vallomásokra reagált a BKV-per keddi tárgyalásán. Mint ismeretes, Balogh a nyomozati vallomásait (Antal Attilához és Mesterházy Ernőhöz hasonlóan) visszavonta, állítása szerint azokat ugyanis a nyomozók nyomására tette. Hagyó – mivel a visszavont vallomások felolvasására sor került a tárgyaláson – mégis reagált az azokban foglaltakra.

Hagyó bevezetőjében kifogásolta, hogy az ügyészség az ő előzetesben tett, okiratokkal alátámasztott vallomásait nem vette figyelembe, míg a szabadlábon lévő Balogh ellentmondásos és iratellenes állításait elegendőnek találta a vádirat megalapozásához.

Balogh Zsolttal kapcsolatos viszonyával kapcsolatban Hagyó leszögezte, hogy soha nem gyakorolt az ő személye felett sem döntési, sem utasítási, sem munkáltatói jogokat, sőt Balogh Zsolt felett még a Fővárosi Önkormányzat vagy annak bármely bizottsága sem rendelkezett ilyen jogkörrel, így nem utasíthatta őt semmire. Hagyó fontosnak tartotta kiemelni, hogy miközben Balogh szükségtelennek nevezett több kommunikációs szerződést, vallomásában máshol így fogalmaz: „Műszaki vezérigazgató-helyettesként elég nagy területre volt rálátásom, de a gazdasági, személyügyi, közlekedési és kommunikációs területet nem ismertem.”

Hagyó kitért Balogh azon állítására is, amelyet már a tárgyaláson tett, miszerint a politikus sokszor raportra rendelte, és ordibált vele. „Ez a kijelentés csak kizárólag annyiban helytálló, hogy a nagy jelentőségű és sürgősen elvégezendő feladatok ellátása érdekében én ugyanúgy, ahogyan a többi illetékes szakembertől, úgy Balogh Zsolttól is megköveteltem, hogy tudása legjavát nyújtva teljesítse feladatát. Így, ha sokszor tartottunk szakmai egyeztetést, ha felemeltem a hangom, ha sürgettem az egyes feladatok teljesítését, akkor ez a nyomás kizárólag azért történt, hogy a Fővárosi Önkormányzat, és egyúttal a fővárosi lakosok velünk szemben támasztott elvárásainak megfeleljünk, és az egyes határidőket betartsuk.” – mondta.

Hagyó utalt arra is, hogy Balogh Zsolt valójában nem félt, nem is félhetett tőle. Felidézte, hogy Balogh Zsolt a tanúkénti kihallgatásakor, 2010. február 8. napján, vagyis akkor, amikor Hagyó még országgyűlési képviselőként mentelmi joggal rendelkezett, és szabad lábon volt, a nyomozó hatóság azon kérdésre igényel-e életének, testi épségének, vagy személyes szabadságának védelmében személyi védelmet, azt válaszolta, hogy: „személyi védelem biztosítását nem kérem.” Később, 2010. szeptember 14. napján azonban, miközben Balogh saját maga is úgy nyilatkozott, hogy ekkor már több mint egy éve nem találkoztak, miközben Hagyó őt a saját állítása szerint sem közvetlenül, sem közvetve nem kereste, vele szemben semmi olyat nem tett, ami félelemre okot adott volna, ő azt a kijelentést tette, hogy fél Hagyótól. „Tőlem, aki hónapok óta fogságban voltam, akit ő meggyötörten, bilincsbe verve, végtelen kiszolgáltatottságban, hatósági emberektől körülvéve láthatott.” – fogalmazott a politikus.
